Katie Hobbs Defies Arizona Supreme Court Decision

Democratic Arizona Gov. Katie Hobbs said Friday that she will not execute death row prisoner Aaron Gunches, regardless of a warrant from the state’s Supreme Court.

On Thursday, the Arizona Supreme Court scheduled Gunches’ execution for April 6, saying it must grant the execution warrant because the appeals process was complete, The Associated Press reported.

But Hobbs said there is wiggle room in the court ruling, according to the Arizona Republic.

“The Court’s decision order and warrant make clear … that the warrant authorizes an execution and does not require it,” Hobbs said in a statement.

“This is consistent with the law and separation of powers between the judicial and executive branches on this most serious exercise of the power of the State,” the statement said.

Gunches was convicted in the 2002 murder of Ted Price, an ex-boyfriend of the woman Gunches was dating at the time. He kidnapped and shot Price multiple times.

In November, Gunches asked the Supreme Court to issue his own death warrant, calling for justice and “closure to the victim’s family.” Former Attorney General Mark Brnovich asked for the warrant of execution, according to KTAR-FM.

But in January, Gunches sought to withdraw the request, citing three recent Arizona executions that were “carried out in a manner that amounts to torture,” he wrote the court.

Democratic Attorney General Kris Mayes, who took office in January, also tried to withdraw the request for a warrant to execute Gunches. On Thursday, the Supreme Court rejected that request.

Hobbs has said she will not allow any executions in Arizona until she receives a report from her Death Penalty Independent Review Commission.

Perhaps a good thing that she is giving the law and the AZ SC a big middle finger before they hear the Kari Lake lawsuit. Perhaps they will be more inclined to take the suit seriously and consider the evidence.

Better prayerfully and carefully re-read Romans and Galatians for the doctrine of the Gospel of the Grace of Christ (no law - Romans 6:14), and re-read Hebrews for the doctrine of the New Covenant of Grace which did away with the Old Covenant of the Law.

There's only two things that defeat sin: death (Romans 6:7) and grace (Romans 6:14) and Jesus did both for us.

Addressing the specific comment from the article “carried out in a manner that amounts to torture,”

Nitrogen Asphyxiations - Flow 99% Nitrogen gas (cheap welding gas) at 1.1 atmospheres to a breathing mask to the condemned. Wait till the brain waves go flat, wait an extra 5 min.

The condemned goes unconscious without the feeling of lack of oxygen.

So what you are saying that keeping the Law in any form is hypocritical? That we should intentionally beak the law in order to maximize Grace?

Exactly. I wasn't attacking you--I was trying to clarify how you view the law--not in regards to our salvation, but in regards to how we manage society.

You claimed I am a hypocrite for trying to follow the Law. I responded by asking how you follow the law, or don't follow the law.

BTW--I am not a hypocrite for trying to follow the law. I also recognize that His grace allows me to repent when I fall short.

Back to societal law, though. You still have not shown that the death penalty was EVER revoked by Jesus, God, or any of His apostles. Lack of revocation indicates that it is still in force.

She is not the legitimate governor.
Therefore she has no legitimate authority to send anyone to their death.
She knows this.

No I didn't unless you claim you actually keep the law like the Pharisees.

In the meantime, since Jesus took the penalty for ALL sins (1 John 2:2, 1 Cor. 5:19), execution is unjust double jeopardy.

she also gave them a legit reason to start a recall..

no more “she cheated to get elected” (not that she didn’t but it doesn’t seem to sell well enough to get traction) now they can say she is violating her oath of office.

No, that was a supposition. I actually hope that supposition is wrong but your attempts to keep the law, STRENGHTENS sin (1 Cor. 15:56).

And, again, execution is unjust double jeopardy.
