New Mexico Property Apraisal Fraud

All New Mexico residents should challenge their property tax appraisals as soon a possible because I am sure I am not the only one:

I am the executrix of my Father's estate in Chaparral, New Mexico. My Father was a WWII and Korean War Veteran. It is a very long story, but the bottom line is that I found a US Army Veteran buyer for the real estate who offered to pay the official New Mexico appraisal value of $83,000 and change --- both of us "aware" that the real value would be higher than his bid. I discussed it with the heirs and all agreed to sell to him at these terms. I sent him the most recent New Mexico tax appraisal, and his loan officer laughed him out of the bank. The bank said the property was not worth anywhere near that valuation amount.

So at the first of this week I contacted the Tax Appraisal Office, and talked to the actual tax appraiser involved in making the assessment. Bottom line again, he has increased the valuation by 3% per year, because he is "allowed to" while watching the property "deteriorate for 20 years" --- he "passes by the property often" he said. He said the real value of the property is going to be around $47,000. At my insistence, he agreed to go out and do a new appraisal for the benefit of the buyer. I am supposed to receive that number by the end of next week.

The Tax Appraiser felt no obligation to render a fair, honest, or legal appraisal because no one had challenged his number. I say he has stolen money from my family for years in tax fraud by commission on behalf of the State of New Mexico.

I reported this to the New Mexico Governor's Office, and have received a same day phone reply from the gentleman in charge of the Tax Appraisal Division. He said he would look into it and get back to me.

I also contacted the investigative reporters at the Las Cruces Sun-News and am awaiting a response. I will contact other newspapers if they are not interested.

I also shared with Republican gubernatorial candidate Mark Ronchetti's campaign by email, and by Facebook message --- so far no reply.

So far no one seems in much of a hurry.

Government bureaucrats think they are untouchable when they fake their jobs and steal from the people they are supposed to serve. Anyone have any other ideas to turn up the heat and hold them accountable??? Thanks!!!

In my state, you need to get an independent appraisal, which then is used to protest what the taxing body wants to claim.

Tax authorities are not required to care about your unsubstantiated thoughts of value.

After the 2008 crash my property value decreased by about 1/3. My property taxes still went up every year.

Local governments simply steal money because they can: How many ordinary citizens can sue?

Tax appraisal offices are not responsible for property owners who allow their property to deteriorate and depreciate. It sounds like your father‘s estate was in very poor condition. $43,000?

It sounds like the tax appraisal was fair and accurate assuming the property was in good condition. It’s not the tax offices fault that your father allowed the property to deteriorate to such a poor condition.

I’ve always felt that the city or county doing the property appraisals must set aside money to purchase at the appraised value the first xx folks that come forward. Maybe the first 100. Maybe the first 10% of the city. Whatever. That would force the appraisers to be fairer.You say my property is worth 20% more than the market says it is? Go ahead, you buy it.

Of course, I don’t like the idea of the government owning all that property, but there needs to be a solution. It is this way everywhere.

There are many valuations for property values. Some states use a taxable value that is lower than a real certified appraiser. I doubt there are certified appraises in the government. Lots of government appraisals are quite high to raise the tax money they can collect.

Tax authorities should be required by lay, and maybe even their own conscience, to give an honest appraisal of the property -— IF he thinks the property is worth $40,000, it should be appraised for $40,000 for tax purposes.

When I lived in Indianapolis, the State forced all counties to revalue all properties by a given date, after which the counties were free to set new property taxes. The Marion Country assessor okay a tax rate increase for my county, approved by the City Council, that increased my annual taxes from $1187 to $4235. Some counties were actually higher rate increases. There was a noticeable explosion from the public. 22 of 25 Council members in Indy were thrown out in the next city election and the public threatened the same action against state legislators.

The city and state backed down in a deal that allows property taxes to increase by 2% per year from the old property tax rates if there was a 1% increase in the state’s sales tax rate. That was voted upon an passed. The drafters of the legislation, however, (purposely?) left a gaping hole in the bill.

It took about 6 weeks for the higher sales tax rate to go into effect and over 3 years for the decreased property tax rates to go into effect. Property tax payers were refunded two year’s worth of the rate increase, but it still amounted to a two year, interest free loan to the state.

Years ago in Alabama they re-appraised property. A friend had two tool shanties on his property left over from when it had been farm land. Nothing more than open face sheds for parking tractors. The appraiser valued them as out buildings. My friend tore them down and asked for a new appraisal. His taxes went up more. The appraiser claimed he improved his property by removing the eye sore!

If there is no law in your state to make taxing authorities “properly” value properties, you have nothing to hold anyone accountable to follow.

This whole issue is only on you, unless you change the law or follow the expected process to protest the valuation.

You, in fact, are even lying when you claim the tax appraiser is “lying,” as you do in your title.
