The body of your thread said you sued them.

What was the legal argument should I need such?

Wawa was trying this in my area.
I called corporate and told them they do not need my name, address, height, eye color and donor status to sell me products requiring ID, they only needed to look at my ID to verify my age.
They first tried to tell me that information was not captured, but I responded that I have used license scanners and EVERYTHING is in that scan.
They seem to have backed off as they are no longer demanding to scan my license.

Your argument using the bill of rights is fines, except those rights don’t apply to any organization other than the government.

Just as one does not have protected speech in a corporation, they are not bound by the fourth amendment.

Stick with the security angle. You will have more success with that.

Ours in Florida does this already. I’m unsure if the info is kept or is used for verification. I’d imagine it’s to protect the store. If a 20 year old shows a fake ID, it doesn’t matter, the clerk can be fined or charged and the store is questioned if not worse. If people would have never used fake ID, this wouldn’t need to be an issue. Blame the criminals.

They will refuse the sale then. Nobody has the right to buy anything.

I have had a few places scan my drivers license, haven’t given it much thought. What exactly is on that encoding? And, yes, what are they doing with it?

Only what they are allowed to see and can use for the transaction.

But all this is stored on some type of database somewhere...

"a card can be demagnetized when close to other magnets or electric motors that use electromagnetic forces such as loudspeakers.

The magnets inside a defunct hard drive are excellent for this. They are very powerful

I just looked this up, state law will require this to sell tobacco and vape products in January 2023 in Nevada. Nothing about alcohol.

HIPAA applies when I purchased alcohol.

My wife wrote the shopping list (Prescription) and she is an MD!

darn near every application I fill out, whether employment or credit or cable TV or you name it, asks for SS#. That's a form of ID in my book.

Again....what state?

State should not matter. privacy is, or is not

As far as I understand this is a blanket Kroger policy. I believe it is wrong in whatever State they do business in.

along with a cart full of groceries.

DEFINITELY bring a loaded cart, so's you can abandon it at the register.

In front of a manager, hopefully.

Can’t you shop elsewhere?

I haven’t shopped at a Kroger, in years.

Good luck with your quest.

Are Kroger stores in all 50 states?

There are 36 US States and Territories without any Kroger locations. Aug 22, 2022

Narrows it down a little.
