Federal investigators are questioning witnesses about former President Trump's conduct and examining his conversations with aides concerning the 2020 election as part of their criminal investigation, the Washington Post first reported Tuesday.
Why it matters: This would mark a major escalation in the Justice Department's investigation into efforts to overturn the 2020 presidential election. The reports came hours after Attorney General Merrick Garland declined to rule out prosecuting Trump.
Federal investigators would "pursue justice without fear or favor" over events surrounding the U.S. Capitol riot or attempts "to interfere with the lawful transfer of power from one administration to another," Garland told NBC News on Tuesday.
For the record: There's no evidence that Trump is himself an investigation target, but "prosecutors are asking questions related to him and his aides," per CBS News, which also reported on the Justice Department investigation.
Driving the news: Prosecutors have questioned witnesses testifying before a grand jury in recent days about conversations with Trump and his close advisers about "fake electors," according to multiple reports.
"People familiar with the probe said investigators are examining the former president’s conversations and have seized phone records of top aides," per WashPost.
Zoom in: Two witnesses who were senior aides to former Vice President Mike Pence in the Trump administration, Marc Short and lawyer Greg Jacob, were among those questioned, several outlets reported.
The focus of the questions on Trump concerned matters such as a plan to thwart the congressional certification of President Biden's Electoral College win on Jan. 6, 2021, according to the New York Times. Short, Pence's former chief of staff, confirmed Monday that he had testified before the grand jury, but declined to comment further.

You need to spend a few hours where I work. The idiots are celebrating and following this religiously. They ignore the recession, inflation and rampant crime and are “distracted” by this BS.
All designed to implant negative, subtle feelings in the electorate about Trump and create obstacles for his return to power. It is important to identify the commissars working within the DOJ so they can eventually be dealt with in a definitive manner. If Trump is reelected he will need competent people to go throughout the Federal deep state and however difficult root them out and prosecute them .

Let’s see, they’ve had the Biden laptop, full of treasonous information regarding the Bidens since October of 2019, but the DOJ won’t comment on whether there is or is not an active investigation.
Meanwhile, in good ole Washington, DC courts, they’ve thrown out cases against the treasonous acts of the conspirators of the Russian hoax, Trump campaign/administration cases.
No problem leaking that DJT is being investigated for NOT doing something that the J6 committee think he should have done. Apparently this “investigation” is based on a referral from the J6 committee that hasn’t had one second of time given to the defense of DJT or to exculpatory evidence. There have already been multiple admissions or convictions for “non-crimes” against other Trump supports in the same Washington, DC courts and by the same Washington, DC prosecutors. As well as the dismissal of charges against the “Colbert gang” for what are the same charges.
Simnply put, the Biden administration/DOJ WILL SUCCESSFULLY charge AND convict DJT. Not because he is guilty, since there is no proof that he committed any crimes, but because there is nothing to stop the corruption.
DJT thought the 2020 election was corrupt, wait until he gets into the Washington, DC courts. Which, by the way, is all the J6 committee has to do before the January 1, 2023 swearing in of the new Congress and Senate.
There will be absolutely NOTHING the new Congress will be able to do once the case is brought before the DC courts . . .
DOJ has given up on charges for the so-called ‘insurrection’, basically because there was nothing there. Now they’ve pivoted to the ‘fake electors’.
Nope... not yet, from my perspective. There’s some pretty dim bulbs out there unfortunately.
