I sure hope Navarro had deep enough pockets to carry it all the way to the Supreme Court. My guess is, any suit by any one not amongst the ruling class will automatically go in front of a very deep state judge appointed by Clinton, Sparklefarts or Dimjo or possibly one of the Bushes.
However even going to the Supreme Court is a crap shoot. There are at least two “pure Constitutional Justices” that are pretty fluid

Violation of Separation of Powers - the legislative branch cannot legitimately usurp the executive branch powers, i.e. law enforcement - by acting as a grand jury in a non-impeachment case.

They have not usurped Article 3 judicial branch powers....yet.
