California Gov. Gavin Newsom (D) vowed Monday evening to build a “firewall” around California in the form of a state constitutional amendment guaranteeing abortion as a right, after a draft Supreme Court decision reversing Roe v. Wade (1973) leaked.

The decision, in the case of Dobbs v. Jackson Women’s Health Organization, concerns a Mississippi law passed in 2018 that bans all abortions abortions after the first 15 weeks into pregnancy. The case was heard by the Court last fall.

At the time, observers believed that the Court was likely to uphold the Mississippi law, based on the comments of justices in oral arguments. Some, however, believed that there were enough votes on the Court to overturn Roe altogether, returning the question of abortion to the states rather than allowing it to continue as a constitutional right implied in the right to privacy.

After the leak of the opinion, supporters of abortion were furious. Gov. Newsom tweeted that he and other Democrats were going to “fight like hell”:

California in the form of a state constitutional amendment guaranteeing abortion as a right,

Legally speaking, can a state declare a constitutional right that is not recognized by the U.S. Constitution?

Yes they can.. they just can't contravene rights explicit in the Constitution... especially the right to a republican form of government, which is explicit along with those in the Bill of Rights. In other words, we can't crown Newsom king...

You’re catching the north east and I’m (TX) catching the left coast. The truck rentals in the TO directions are insane. Where in the back flow direction they are dirt cheap.

Yeah I’ve heard that about the rental trucks.

I’m mostly seeing VA, NY, NJ, mass, penn, some Cali, TX and va.....among others.

While it pisses me off at the same time I get it.

Another thing that pisses me off is yankees moving here and complaining that it’s somehow inferior to “up north”.

I had to delete my nextdoor account because I couldn’t take that 5h!t anymore.

Border Guard: "Are you carrying any weapons, contraband or disinformation?"

Traveler: "No, I'm here for an abortion."

BG: “Fine, pass on thru, ma'am."

Traveler: "That's really kind of misogynistic calling me "ma'am". Besides, you really don't know how I identify."

BG: "You are correct, citizen. My apologies. Please, have a pleasant and successful stay in California."

If there truly is a majority now willing to overturn Roe V Wade, I am fairly certain that same majority will respect California’s right to put abortion rights into their state constitution. That is a state’s right that the justices that wrote Roe refused to respect.

Wish he’d vetoed it and then if overridden then so be it.
