Tort Law is the same throughout the Country.

Please explain how do you expect a patient in Cardiac Arrest to receive Cardiac Medications??
They can’t give permission because their heart has stopped!!

It’s called “Implied Consent”.

I’m going to consent for them because any reasonable person in the same situation would want life saving medications to save their life.

“General Consent”………Consent by verbal or written declaration to any necessary medical treatment.

“Informed Consent”……………….I tell you what medical procedure is needed or what medications are ordered before the treatment begins and you give consent each step of the way.

Someone unconscious can not give General Consent or receive Informed Consent.
The medical professional tending to them uses Implied Consent assuming any reason person under the same circumstances would want the treatment.

Implied Consent isn’t just for unconscious patients……..patients not aware of person, place or time……..patients suffering from a psychotic episode, drugs and alcohol, and Minors.

Hospitals, EMS and surrounding responders will actually LIE to implement their attending hospital’s policies. “Unable to respond, ‘family wishes,’ 10-12 threat to self or others, and so on depending on state laws.” It can only have gotten worse with Covid and the financial benefits available to hospitals.
They isolate, obfuscate actual events and conditions and will even deny access to hospitalized individuals.

I’ve been there, done that (not with Covid, however). I was in an ICU against my will. They intentionally put the phone completely out of my reach to keep me from contacting a lawyer, IMO.
