This is the fifth in a series of articles analyzing the 27 page federal grand jury indictment charging lawyer Michael Sussmann with making a false statement to the FBI.
As stated in the fourth article, when the FBI learned of the alleged hack of the Democratic National Committee’s (“DNC”) emails, it asked to examine the server.
In fact, at the same time as the alleged DNC hack, there were similar reports regarding the Democratic Congressional Campaign Committee’s (“DCCC”) server as well as DNC Chairman John Podesta’s personal email devices.
In testimony before the Senate, FBI Director James Comey stated the following:
Question (by Senator Burr): Did the FBI request access to those devices [the servers and Podesta’s devices] to perform forensics on?
A: Yes, we did.
Q: And would that access have provided intelligence or information helpful to your investigation in possibly finding … including to the Intelligence Community Assessment?
A: Our forensics folks would always prefer to get access to the original device or server that’s involved. So, it’s the best evidence.
Q: Were you given access to do the forensics on those servers?
A: We were not. We were … a highly respected private company eventually got access and shared with us what they saw there.
Q: But is that typically the way the FBI would prefer to do the forensics or would your forensic unit rather see the servers and do the forensics themselves?
A: We always prefer to have access hands on ourselves, if that’s possible.
Q: Do you know why you were denied access to those servers?
A: I don’t know for sure. Um, I don’t know for sure.
Q: Was there one request or multiple requests?
A: Multiple requests at different levels and ultimately what was agreed to is that the private company would

There was no hack.
Seth Rich was the leak and they killed him for it.
That’s what the FBI is trying so hard not to see.
Great article. Well written, which is rare, and “wow”, with absolutely No Nuance to muck up the Facts.
Years ago in the 70’s I read The Doorbell Rang by Rex Stout, which is fiction. The FBI was corrupt in that book, but I knew it was just fiction. The FBI is actually corrupt now, and we all know it because of what they did to Trump.
Somebody needs to take a course in being evasive without sounding evasive.
PS: So much is overlooked in the quest for stalling findings, right through the Statute of Limitations.
Seth Rich deserved better, and maybe Durham will bring something on that case that was dead before it started.
Durham has certainly had time to open one.

All these actions happened in 2015 and 2016.
Durham embracing dragging it into 2022 and beyond is not a good sign any way you cut it.
I think Merrick Garland is making the decisions.

I don’t remember the statue of limitations for all the lying, cheating, and stealing, but murder has no statutory limitations. Someone can still be charged even in the death of the assailant(s).
Keeping my fingers crossed.
Alternate analysis is that garland is hands off and letting the investigation run its course. Garland is part of the Uber progressive wing and tossing some aging main stream Democrats that will give rise to more Marxist progressives gaining power. Podesta has money and clout but he’s close to the end of his reign due to age. The Clintons have been neutered due to scandals and ineptitude so bringing them back is not in the progressive’s interest. Garland et al what to fundamentally change the US and throwing old guard and hacks to the wolves will look like cleaning house and show how responsible they are making way for the new blood of the party.
Great post.
Thanks.
The author, George Parry, is a former federal and state prosecutor who practices law in Philadelphia and blogs at knowledgeisgood.net.
Former prosecutors really know how to lay out the facts in a clear, concise manner, don’t they?
Comey sure didn’t “remember” much, did he? And he was our FBI director, or as we old spooks like to call the Bureau now, the Federal Bungling Investigators.
McCabe got his pension back. Nothing like rewarding a Deep State traitor while those in the field get shot and killed.
🙌
It’s no different than how the mob rewards the wise guys who go to prison for keeping their mouths shut.
because of what they did to Trump. and so very many other instances.
FBI is crappola with agendas
Q: Do you know why you were denied access to those servers?
A: I don’t know for sure. Um, I don’t know for sure.
