From the article (much more in the article):
He also said that Vice President Pence violated the Constitution on December 23, by not sending a letter to those states, demanding that they correct the fraud. As National File reported, US Code actually prohibited Pence from accepting electoral votes from fraudulently certified states. Additionally, Raiklin said that Pence violated the Constitution a second time on January 6 by “not setting up an environment to correct the fraudulently certified electoral slates from these six contested states.”
PING!
Hey, The GOPe didn't get the nickname of "The Surrender Monkeys", on thier own.
The RINOS and GOPe had help, and the ''tangos' are within the wire' demonstrates the extent of the infiltration.
Whatever. We can deal with 4 or 8 years of Biden/Harris and come out fine, just like Obama.
I’m prepared. Going to work every day, taking care of my family, and enjoying life. That is the best and most healthy thing any of us can do.
What states? There has been no fraud litigated. Alllegations, yes. Pence is not the arbiter of fraud in all 50 states and entitled to send specious letters telling the states how to do their jobs.
If elections don’t follow the laws set up by the state legislators, then that is a state issue, and we saw several lawsuits that went nowhere because of this. Once the electors were certified, it was game over.
Sorry, I really am at a loss as to why you don’t get it...
I’ve no more time to devote to kibitzing with you... Said I was not going to rehash (broke my word), and yet here we are...
Do a search of Pence at Free Republic in January. Go to National Pulse, many articles...
Meanwhile I am going to watch War Room as it is starting and I want to keep up with the the AZ, NH, and GA audits progress and other important news.
For likely the THIRD time, I am saying we are going to have to agree to disagree on our OPINIONS.
Enjoy your day.
Oh now you’ve done it ready....you have questioned the holy grail thinking that there was this massive nation wide scheme to cheat Donald out of his votes. You will now be cast into the fiery pit of condemnation, call a traitor/troll/watcher of cnn, etc.
I do not believe there was this massive 5million vote fraud done in the election. The sheer scale of coordination, etc. and the possibility that someone would talk are just to ludicrous to believe. I do not discount the fact that some votes may have been screwed up....it happens in elections. I don’t believe that the voting machine vender Dominion is some doctor evil trying to sell the country out to the commies by rigging votes.
But I’ll continue to live my life, go fishing, drink cold beer and not get too worked up over politics....cause arguing here won’t change a thing.
Nothing there about Ruby Freeman. Unless you're suggesting somebody suicided her.
Not only would that help President Trump, but it would affect the Ossoff-Perdue race.
Well that's absurd. The Vice President has no role or authority to do anything other than to preside over the tabulation of the votes.
You’ve got it right. The veep has no authority or mechanism under the Constitution or any law giving authority to do what some people claim. Those are facts, not opinions.
It's not an opinion. Have you ever read the US Constitution? It is a fact. Simple as that. You don't need a law degree to read it and understand it. No mechanism exists under either the Constitution or law for the VP to do what you claim. No such power, authority, or role exists for the VP.
You can always find people with miles of degrees and credentials who can make nonsensical statements not rooted in any semblance of reality. That doesn't give them credibility.

Jenna Ellis, senior legal adviser to the Trump campaign, floated the idea Monday afternoon during an appearance on the Just the News television show The Water Cooler with David Brody.
“What Mike Pence could do, and what he should do, in fact, is to direct a question back to the state legislatures when there are two competing slates of delegates from these six states, he can ask that question to the states and say, ‘well, state legislators, you know, I have an oath to the Constitution to uphold the Constitution as written in Article II Section 1.2 which says the state legislatures direct the manner in which electoral delegates are selected. So you tell me which of these two slates was selected in the manner that your state general assembly has designated,’” Ellis said.
So Ms. Ellis seems to think he could have done something.
In fact, Pence, himself, thought so too—on January 2. “The Vice President welcomes the efforts of members of the House and Senate to use the authority they have under the law to raise objections and bring forward evidence before the Congress and the American people on January 6th.” 2/2 From his Chief of Staff’s Twitter

VP Mike Pence Just Issued Statement…The Fight is on!
Epoch Times via Populist Press ^ | 01/02/2021
Vice President Mike Pence said he welcomes efforts by lawmakers to challenge Electoral College results in the upcoming congressional joint session on Jan. 6, when the votes are formally counted, according to a statement sent by his chief of staff to reporters.
Vice President Chief of Staff Marc Short issued the statement on Saturday saying that Pence, who will be presiding over the Jan. 6 session as president of the senate, is open to considering planned objections by Republican House members and senators to Electoral College votes cast for Democratic presidential nominee Joe Biden.
Short added that the vice president also welcomes efforts by lawmakers to present evidence of election irregularities and alleged voter fraud before Congress during that session.
“Vice President Pence shares the concerns of millions of Americans about voter fraud and irregularities in the last election,” Short said in the statement sent to media outlets.
This comes after a group of 11 Republican senators announced their intention to challenge the electoral college votes from contested states earlier on Saturday. The group, led by Sen. Ted Cruz (R-Texas), said the 2020 election “featured unprecedented allegations of voter fraud, violations, and lax enforcement of election law, and other voting irregularities.”
The allegations of fraud and irregularities in the 2020 election “exceed any in our lifetimes,” they said, adding that this “deep distrust” of U.S. democratic processes “will not magically disappear” and “should concern us all,” whether or not elected officials or journalist believe the allegations.
“It poses an ongoing threat to the legitimacy of any subsequent administrations,” the senators wrote in their statement, while calling on Congress to appoint an electoral commission to conduct an emergency 10-day audit of the election results.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
So:
1. Someone (A talented attorney.) has a different interpretation than you...
2. Pence, himself, thought there was a lawful right for members of the House and Senate to use the authority they have under the law to raise objections and bring forward evidence before the Congress and the American people on January 6th.
3. Something changed between 1/2 and 1/6. Pressure on Pence? the Capitol incident? I do recall reports that Pence was angry with Trump. I don’t claim to know. However, when the Congress resumed the Electors certifications that evening (which may not have even been lawful), the process to raise objections was ended.
Many agree that Pence could and should have done more...
As I stated to the original person to whom I was replying, I am not going to rehash this...It was already done on this site in January.
If you don’t agree fine...However I have spent enough time dialoging with the original poster on this subject.
Have a good evening.
I know that. You know that. But half of the Freepers are expecting a military junta, and Trump parachuting onto the WH front lawn this summer. It’s unreal.
