_Biden Creating Commission to Look Into Packing the Supreme Court

The Biden administration has created a commission to look into packing the Supreme Court. The Democrats are looking for a way to cancel out conservatives that were appointed during the Trump administration.

The court is currently made up of six conservative justices and three liberals, after the death of Justice Ruth Bader Ginsberg.

“President Biden on Friday will order a 180-day study of adding seats to the Supreme Court, making good on a campaign-year promise to establish a bipartisan commission to examine the potentially explosive subjects of expanding the court or setting term limits for justices, White House officials said,” according to a report from the New York Times. “The president acted under pressure from activists pushing for more seats to alter the ideological balance of the court after President Donald J. Trump appointed three justices, including one to a seat that Republicans had blocked his predecessor, Barack Obama, from filling for almost a year.”

The act of “packing” the supreme court with your own toadies is a tacit admission that your intent is to ignore the U.S. Constitution.

It is a direct assault on the three branches of government designed by the founding fathers.

I abhor the radical left, but you must respect how they wield power compared to “conservatives AKA the GOPe.”

The left plays to win. They continually fight. They constantly set up the next fight and the one after it. When they have power they wield it ruthlessly with no real thought towards decorum, “bi-partisanship”, consensus, or all those other weak words that republicrats hide behind.

I have thought for the last few decades that the consensus crowd would be the first killed off and here we are.... all that “meet them in the middle” took us in the wrong direction for decades and now the “center” has moved further left than the liberals ever dreamed of only decades ago.

My guess is that this is a sign of retreat. Appointing a study commission is always a good way to kill a proposal. This one would finish its work in Oct. 2022, right before the election. Hard to imagine they’d want give Republicans an issue like this at that time.

One suspects that a chunk of the COVID “relief” will go for overpriced salaries for these buds of the big guy, who will mutter and mutter for months, maybe even years before issuing a report that the unintelligible AOC would envy.

That it can be done is a no-brainer. The number of seats on each of the various federal courts, including the Supreme Court is set by statute, and that statute can simply be amended to increase the number of seats.

Decreasing the number of seats requires that it be in the form of a "hiring freeze" - i.e., you can't kick a judge off, but you can provide that the seat ceases to exist when its incumbent dies or retires.

If Biden and Schumer were really aggressive, they would increase the size of the Court and persuade Breyer to retire, fill all of those seats, and then decrease the size of the Court again so that the oldest remaining Thomas, Alito and Roberts can't hold out and retire under the next Republican President.

I imagine that the Democrats will try to get traction with packing the Court. If they get a lot of resistance the commission will “find” that packing the Supreme Court is a great idea but, unfortunately, they don’t have a clear path on how to do this. The Democrats can then tell their base that they “looked into it” and theoretically support it, while not doing much. But if the Democrats think they can roll over any opposition, then say hello to a Supreme Court made to order for the Democrats.
