The 107 page lawsuit against Giuliani was filed in the Federal District Court in Washington, D.C., on Monday morning.
Dominion claims that allegations of election fraud were “demonstrably false.” It also brought up the protest at the Capitol on January 6 for some reason. In fact their announcement to attack Rudy Giuliani reads like something from a far-left publication.
Later this morning Rudy Giuliani responded to the Dominion Voting Systems announcement.
Rudy says he looks forward to investigating their history, finances and practices fully and completely.
Via WABC Radio:
Giuliani, who is also a host for WABC radio, issued the following statement:
“Dominion’s defamation lawsuit for $1.3B will allow me to investigate their history, finances, and practices fully and completely. The amount being asked for is, quite obviously, intended to frighten people of faint heart. It is another act of intimidation by the hate-filled left-wing to wipe out and censor the exercise of free speech, as well as the ability of lawyers to defend their clients vigorously. As such, we will investigate a countersuit against them for violating these Constitutional rights.” – Rudy Giuliani

Even if RG’s claims were demonstrably false, they’d have to prove he KNEW his claims were demonstrably false when he made them.
Dominion must know who the judge will be. In the old days, the judge would look to the law to determine his/her decisions. Rudy only gets what the judge says he can get.
Try some new material for heavens sake. Even the 9th circuit is essentially tied after all of Trump's appointments.
“Rudy can’t sue them for violating his constitutional rights because they are not the government. A new law student would know that.”
No, but he can sue them for discrimination based on political leanings. What the left did these past four years with the doxxing and cancel culture, something can be said for taking this all the way up to SCOTUS, with Professor Dershowitz and Dr. Levin arguing for Guiliani.
Discrimination based upon political leanings or beliefs is not illegal.
“No problem, if and when Dominion has to produce source code, they will scrub anything damning out of the source code before they hand it over. “
Okay, I admit it has been a long time since I wrote any code. But my recollection is, you can’t just take stuff out without doing a whole lot more work to make sure it all works. Also, since the code is apparently accessible via the internet, it’s likely that the defense will have a copy and the two won’t match. This could be a problem if the illegally copied code can be shown to work and probably the supplied code will have a lot of bugs in it.
Likely the code has been worked on over the years by lots of individuals who have different styles. That further complicates just taking out the incriminating parts. In addition, it might be possible to get former employees to testify against Dominion. Sure, they may be disgruntled, but they may be able to point out where the bodies are buried.
Dominion, which I believe does have a lot to hide, is making a big mistake going to court.
It’s going to end up reinforcing that Rudy does a lot better spouting off to the press than he does in court. Rudy isn’t going to get crap from discovery. Dominion will only be required to disclose information directly related to the case and Rudy’s alleged defamation.
Claiming this suit “will allow me to investigate their history, finances, and practices fully and completely” rather than saying “I have evidence” clearly shows his predicament. Threatening a counter suit is desperation. Rudy is screwed.
They’ll be on losing end if Rudy does disclosure
Which court of appeals?
> Dominion shows video and makes claim Rudi made money from his podcasts slamming them and then pushing some vitamin sales during podcasts. $20.00 vitamins. Geeze Rudi.
Oh, yeah. He was pushing lots of different products and services during his podcasts — vitamins, title insurance, cigars, etc. I watched several of his podcasts and he comes across as sleazy as hell. It is hard for me to take him seriously. I think he’s gonna get his arse handed to him in court. He’s definitely been playing fast and lose with the truth since the very beginning.
“Discrimination based upon political leanings or beliefs is not illegal.”
Not yet. Then he should say he is an old white man. I believe there is discrimination there.
You don’t know what you are talking about. Private parties are sued for violations of constitutional rights ALL THE TIME.
Have you never heard the phrase, “spoliation”?
Yes, I think that this will be a case of “Oh, Brier Fox, don't throw me in that Briar patch!”
I certainly hope this backfires on Dominion.
Unless some judge limits it excessively to protect Dominion. And based on the courts handling of all things election related (or rather, outright refusal to handle it) that’s a real possibility.
Your recollection is 100% correct.
Not only work, but also be able to "build" successfully when needed to, and that rebuild produce the same program that was running at election time.
Counter-sue, then they can’t just drop it.
Dominion simply isn’t going not comply to the discovery requests and the court is going to let them get away with it.
Ugh. That makes sense.
what’s your take on Rudy’s position on a case like this?
