US Attorney and legal scholar Alan Dershowitz joined Maria Bartiromo on Sunday Morning Futures this morning to discuss Nancy Pelosi and the Democrat Party’s latest plans to impeach President Trump before the inauguration ceremonies next week.
According to Alan Dershowitz Democrats have zero chance of impeaching President Trump this week or after he leaves office.
Alan Dershowitz: “The case cannot come to trial in the Senate. Because the Senate has rules and the rules would not allow the case to come to trial until, according to the majority leader, until 1 PM on January 20th an hour after President Trump leaves office. And the Constitution specifically says, “The President shall be removed from office upon impeachment.” It doesn’t say the former president. Congress has no power to impeach or try a private citizen, whether it be a private citizen named Donald Trump or named Barack Obama or anyone else.”

There are no timing limitations on the use of the Impeachment process in the Constitution. So there is no limit in the Constitution for impeaching someone after they have left office.
There are Senate and House rules regarding impeachment but rules can be changed with a majority vote.
I saw Dershowitz on Maria’s show this AM..
Since impeachment is to remove a sitting President, you can’t hold a trial to convict and remove - when the President is no longer in office. As an example, Dersh said we could not impeach and hold a trial against Clinton, Obama, etc at this point. Heck, if you could impeach and convict a former President, I suppose we could go all the way back..
Of course, little things like the Constitution seem to basically not matter to many any longer, so all bets are off as to what these idiots will try.
Funny thing. I just said those words on another thread a minute ago. The House cannot impeach private citizens.

Wouldn’t Congress indicting/trying a private citizen constitute a Bill of Attainder? And doesn’t the Constitution specifically ban them?
lol..impeachment is strictly a POLITICAL matter...not criminal....these people....
Legal issue could go either way.
The winning argument might be that a political majority might start impeaching and disqualifying their opponents after every election.
Which of course is exactly what democrats are doing.
The House can send the articles of impeachment to a floor vote next week, that is the first step of the impeachmemnt process, the Senate conviction trial is down the road.
They want to impeach him this week. They can if they have the votes.
He can then be tried in the Senate. But the Senate can not take up the case until after January 20 at 12:00. The question is can they try and convict him after he leaves office? There, I think Roberts says the case is moot.

The Constitution doesn't grant Congress the power to impeach a private citizen.
And it would look pretty stupid trying to remove somebody from an office that they don't hold.

Impeachment is a House function, the Senate has nothing to say about it.
