Rep. Gohmert Files Response to DOJ/Pence, Argues VP Can Count GOP Electors in Contested States, Ignore Electors From Others

Rep. Louie Gohmert has filed a new document in the lawsuit brought on by him and other Republicans to stop the Democrats from stealing the 2020 election.

The new filing argues that Vice President Mike Pence has the authority to count Republican electors in contested states, or ignore the electors from those states all together.

"Under the Constitution, he has the authority to conduct that proceeding as he sees fit,” Gohmert argues. “He may count elector votes certified by a state’s executive, or he can prefer a competing slate of duly qualified electors. He may ignore all electors from a certain state. That is the power bestowed upon him by the Constitution.”

I thank Representative Louie Gohmert for at least fighting for Donald Trump, unlike some Republican politicians.

Interesting. It doesn't say that anywhere in the Constitution.

Rep Gohmert is incorrect in his assertion.

The 12th amendment specifically enumerates that "...The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted. ..."

The President of the Senate is not granted the authority to either open or count only some of the certificates. This is a required procedural step to allow objections. By law, objections require one senator and one representative to object.

I don’t see this as logical. If each state can send to different slates of electors, the VP picks who he wants. This doesn’t work or I’m missing something.

12th Amendment doesn’t retread the definition of ‘Elector’.

If it is demonstrable that a slate of Electors has not been appointed under, solely, the direction of the State Legislature in question, Pence has no obligation to accept them.

If a certificate is not self-evidently bonafide, it is not a certificate at all.

One big problem is the electoral count act of 1887 specifies the tie breaker goes to which slate has a certificate signed by the governor of the state. Brian Kemp, governor of Georgia, has refused to even have a special session of the Georgia state legislature.

I don’t believe he’s at liberty to just decide which electors to count or not at his leisure. I haven’t read the rule and I didn’t stay at a Holiday Inn last night. If you have read it or stayed at the Holiday Inn last night then I guess your logic rules.

Agree. I can write a certificate claiming a rock I found in my backyard is a moon rock worth over $1 million dollars... and it would have VASTLY more legitimacy that Michigan or Pennsylvania’s certification of the election results.

The rock in my back yard... COULD be a moon rock... and the odds of that are greater.

But, there’s obviously more to it...

Pence has a moral, legal, and Constitutional obligation, instead, to PREVENT fraudulent elections... and fraudulent certifications... by refusing to recognize them as anything other than fraudulent.

If Governors have practiced frauds and obstructed the legitimate elections process... by conducting FAKE elections... or by preventing Legislatures from addressing and correcting their crimes: Pence has an obligation, BEFORE selecting any such tainted elector, or corrupt slate... to UNOBSTRUCT the process enabling accountability.

Right now... the country formerly known as the United States... is being operated OUTSIDE the law... and in result it is not United.

Lincoln knew how to handle that problem.

That’s not a task to WAIT to address ONLY on or after the January 6th “scheduled meeting”...

Arrest Bill Barr... or arrest Mike Pence... but certainly arrest those Governors and Secretaries of State perpetrating frauds...

I don’t care who you arrest... but FIX IT... Pence. THAT’s your job... to “see the laws are faithfully executed”.

If Legislatures are being wrongly prevented from acting as they are required to act... the obstruction in a fraud stops the “real” clock... which should not resume until the obstruction and its functional impacts... have been eliminated.

Justice delayed, is justice denied... and the natives are growing restless.

No, he’s not “at liberty”... he is under OBLIGATION to determine the LEGITIMACY of HIS OWN acts.

And, he is RESPONSIBLE... the ONLY ONE WHO IS RESPONSIBLE... for the PROPER conduct of the election on Jan 6th.

Words matter. Going through the motions or pretending your acts are not BOUND BY TRUST ?

Not a single one of those fools I see... is capable of TRUST sufficient to be bonded as a cashier at 7/11.
