Ohio Attorney General Yost Taking ‘Deep Dive into the Legal Theories’ of Texas Lawsuit Filed in U.S. Supreme Court

Texas Attorney General Ken Paxton filed a lawsuit against Georgia, Michigan, Pennsylvania and Wisconsin in the United States Supreme Court, according to the AG’s December 8 press release.

The Lone Star State’s top legal advisor alleges that the four states broke federal election laws by ignoring the role of the legislature in each state to choose electors and make election laws.

The Center Square reported attorneys general from Alabama, Arkansas, Florida, Kentucky, Louisiana, South Carolina and South Dakota are also expected to join Texas in the lawsuit.

The Ohio Star contacted Ohio Attorney General Dave Yost to find out if Ohio will join.

The Star’s asked AG Yost’s office:

Will Attorney General Yost be signing Ohio on to the Texas case filed with the Supreme Court?

Or, will he file an amicus curiae brief? Both? Neither?

Why? Why not?

Bethany McCorkle, spokesperson for Yost, responded, “We are doing a deep dive into the legal theories and factual allegations in Texas and will make a decision once that is completed.”...

Well, it sounds as if there is at least a 50/50 chance Ohio will join the Texas lawsuit.

Is Ohio’s AG appointed by the Governor or is it an elected position? If elected, DeWine can go pound sand as there shouldn’t be anything precluding the AG from filing an Amicus or joining the lawsuit itself.

Elected. Dave Yost (R) defeated Steven Dettelbach (D) in the 2018 general election for Ohio Attorney General.

Since the USSC has this on their schedule, I believe they will find in favor of certain States going against their own State constitutions before or mid-stream without their Legislatures creating new and signed laws.

Always remember why Gore lost to Bush in 2000. Florida tried to change their own State constitutional laws during the recount. That is precedent and the same issue is before the Supremes.

Elected. But we all know that political power is more than just elections. However, I do believe DeWine has spent most of his power playing king.

If the USSC rules that administrative agencies can rewrite the laws of their state at will we may as well not have legislatures any longer.

Don’t forget Gov. DeWhiner moved the primary date and to an all mail in. vote. In addition...

They may be afraid to throw stones. It may bounce back ans hit them.

This is not an allegation. This is simple, black-letter Con Law.

That said, I don’t anticipate much from SCOTUS. Nor do I expect much from the legislatures who would, under a best case scenario, have to pick their electors. So many Republican state legislators can hardly wait to install biden......

Even so. For those wishing to consult the Constitution, this is a no brainer. Alas.

Agreed. Since Democrats favor such a future the decision by the court should be in Texas’ favor but only by a 6 to 3 vote. Or, more likely by 5 to 4.
