Democrats May Have Violated Civil Rights By Forcing Nursing Homes to Admit COVID-Positive Patients

...“Protecting the rights of some of society’s most vulnerable members, including elderly nursing home residents, is one of our country’s most important obligations,” Assistant Attorney General for Civil Rights Division Eric Dreiband said in a statement. “We must ensure they are adequately cared for with dignity and respect and not unnecessarily put at risk.”

The DOJ’s Civil Rights Division is considering launching investigations under the Civil Rights of Institutionalized Persons Act (CRIPA), which protects the civil rights of persons in state-run nursing homes, among other institutions. “The Civil Rights Division seeks to determine if the state orders requiring admission of COVID-19 patients to nursing homes [are] responsible for the deaths of nursing home residents.”

The DOJ cited Gov. Andrew Cuomo’s (D-N.Y.) order on March 25 that “no resident shall be denied re-admission or admission to [a nursing home] solely based on a confirmed or suspected diagnosis of COVID-19. [Nursing homes] are prohibited from requiring a hospitalized resident who is determined medically stable to be tested for COVID-19 prior to admission or readmission.”...

Don't get me wrong, I want to see the investigation go forward. But plenty of states, including red states, had percentages of nursing home patients dying of COVID-19. But maybe they sent known COVID infected patients who were in a hospital to an isolation facility. If they didn't, the governors of those states should suffer the same fate.

I could see them tried and found guilty of INVOLUNTARY MANSLAUGHTER under 18 U.S. Code § 1112. They could be fined and/or get up to 8 years in federal prison if found guilty.

Cuomo also allowed confirmed positive staff to continue working at their facilities until he changed the policy in mid-May.

That needs examination as well.

Also look into the percentage of the dead who were dual-eligibles. I’m betting Medicaid costs likely entered into this.

They emptied the prisons because we couldn't’t have all those people crammed together because of the Covid, but no problem stuffing the sick into old folks homes. Surprise,Surprise, Surprise.

I agree, it is murder, but I will settle for negligent homicide.
