The proof standard for an arrest on a complaint is probable cause that a crime has been committed. Probable cause is also the standard for indictment, but theres an important difference. Complaints often get dismissed; indictment is that beginning of the formal process that leads to trial and a determination of guilt. Prosecutors thus do not indict unless they believe a rational jury could find guilt beyond a reasonable doubt, a standard more demanding than probable cause.
In the typical street-crime case, then, a person is arrested on a complaint and either detained or granted bail. Within a certain statutory period of time (usually, within ten to 30 days, depending on whether the person remains in custody), the prosecutor must make the decision whether to indict.
It is in that interim that the investigation proceeds. Investigators tighten up the proof from the low standard that justifies arrest to the higher standard needed to prevail at trial. But it is the norm for a violent-crime suspect to be placed under arrest immediately, notwithstanding that the case may not yet be ready for indictment. This prevents flight, destruction of evidence, intimidation of witnesses, and danger to the community....

i cant believe the media is completely omitting what the autopsy report says about NO NECK INJURY FOUND...even Sean Hannity made an ass out of himself all week, screaming hysterically that hes a “MMA expert and blows to the carotid artery can kill in 15 seconds”....where were these so called blows to the neck?. The tape looks bad but alot of law enforcement “looks bad”. Unless they can prove this cop “strangled him”, they have zero case. Thats why the weird “3rd degree murder charge”. Im not a lawyer and even i could destroy this case in an hour...perfectly legal stop and arrest..no one was profiled...no one was punched or kicked or tased or shot. And the neck restrain is still allowed by the MPD. When you resist arrest, bad things happen. Thats totally on the perp. And the toxicology results arent even back yet. Got a good idea how what that will show.
Why Did It Take So Long to Arrest Derek Chauvin?
Because the autopsy said his actions did not cause the death of the suspect?
how about his criminal activity contributed to his death...theyll never get a conviction and by the look on the prosecutors face, he knows it.
B-I-N-G-O.
again?
So long? It usually takes 4-8 months for a police officer to be arrested in such situations. Show us a faster arrest.
One cop, not four. And prove to me that cop was putting any weight on Floyd’s neck. How was Floyd able to keep talking so long?
I say the officer’s weight was on his right leg. His left leg was ready in case he Floyd (who was 6’ 6” and an ex bouncer) tried to get up.
What I’m saying agrees with the autopsy result.
that guy man..i dont understand how he gets his ratings...im talking head made of cement.
Hannity replaced him ...
He was a moron way back then too ....
watch the tape closely..the cop is slightly lifting and lowering his leg ..he didnt smash and grind his knee into his neck..just like he was taught to do by the MPD. Bet they didnt even find bruising....hysterical overreaction ..as usual.
Thank you!
they tried for 10 minutes to get him in the car...and couldnt. Thats the video you dont see!!...geez...
Right you are. Floyd wouldn’t have been conscious 30 seconds with real weight on his neck. I had the method used on me with one finger by a cop and I was headed for the floor immediately and feeling faint! I would have been out in seconds. One finger.
This is a cyber lynching, that’s all.
Why dont u post it so we can all see.
The 4 officers could not get him in a patrol car?
You know, the 4 officers who got fired.
Please post the video you mention.
“Why dont u post it so we can all see.”
Why wait, I bet you can find it easily. And remember that Floyd was 6’ 6’’, and a bouncer by trade.
Im not the one who mentioned he fought for 10 minutes and apparently
4 officers could not get him in a patrol car.
My advice. Dont run your mouth without proof just because u heard something.
Get back to us when the video appears.
It is a good idea to read what one posts and back it up with critical thinking, facts and lessen the emotionalism. We are treating this Floyd incident the way the left is.
There were many videos, and they all showed the cop kneeling on the guys neck. Why do you defend the indefensible? You make all of us look like racist idiots.
