Remember when CNN was pretty much ‘Peachmint’ 24/7? That all ended yesterday when the Republicans finally got up to bat. And yes CNN, people noticed:

After airing every last second of Democrats’ opening statements plus Democrat staffers talking to each other throughout six extremely boring impeachment hearings, CNN refused to air Senate Judiciary Committee Chairman Lindsey Graham’s opening statement in the hearing on the IG report today. Instead of informing viewers of the incredibly damning facts regarding the Obama-Biden FBI’s spying on the Trump Campaign in furtherance of the Russia Collusion Hoax that CNN spread for years CNN turned to the same ‘experts’ who spread the hoax for their takes on the IG report…This is Putin-style propaganda at its finest! - Daily Wire

Others were more blunt:

I created an artistic statement in honor of this momentary triumph of fake news over truth, justice and the American way. I hope to sell it for something north of the $120k they got for that over-ripe banana wall art at Art Basel Miami. It’s the first in what I hope to be my ‘Peachmint’ series:

I’ll have to split the proceeds with Zephyr, since it was her idea. If I can get$125k - not an unreasonable figure  for a transient fruit art these days -  we’ll both clear about $10.99 after paying commissions to the gallery, art dealer and art agent.

and ‘Jello Strong,’ aka ‘Nailing Impeachable Offenses to the Wall.’

I have a long list of people I want to see serve some prison time over the Russia hoax. I don’t know if entire businesses can be indicted/charged/convicted, but CNN and MSNBC deserve to share in the blame. They went along with the hoax, knowingly on unknowingly, but should’ve seen the writing on the wall when the facts just weren’t there. Instead, they made up facts to try and fill in the blanks.

I watched a minute of Moaning Joe this morning.

As unbelievable as this may sound, they said the report exonerated the FBI and proved that Trump was lying about being spied on.

Weird, right?

Nobody can say everything they think they know - “Ain’t nobody got time for that” - and yet, “Half the truth is often a great lie."

Objectivity is a wonderful goal to strive for, but it is not a state of being - and claiming that it is the state of being of yourself (or of fellow members of a mutual admiration society) is arrogance. The First Amendment does not assert, much less require, that journalists are or should be objective.

In fact, per Antonin Scalia, the First Amendment did not create freedom of the press! Shocking, but obviously true. Freedom of the press -freedom as limited by laws against libel and pornography - existed before the Constitution was even composed. Ratification of the Constitution was obtained by the Federalists only after they yielded to the Antifederalists a promise that a Bill of Rights would be expeditiously added by amendment.

The Federalists were not about changing the rights of the people, they were about a strong overall government which would end the de facto status of the “united” states as independent but weak. Accordingly the first eight amendments simply state certain accepted, existing rights in the least controversial manner possible.

No pretense is made that those rights were/are exhaustive, for the simple reason that the rights of the people were and are a matter of common law - nowhere specifically and exhaustively enumerated. Attempting to enumerate them all in that fashion would have been a contentious undertaking, making the addition of a bill of rights a potential poison pill which would provide unlimited openings for Antifederalist criticism.

The first eight amendments stipulate only those rights which, history suggested, tyrants were prone to deny. All other rights - the right to sue for compensation for libel, for example - are covered in the Ninth Amendment:

The enumeration in the Constitution, of certain rights,
shall not be construed to deny or disparage others retained by the people.

“The” freedom of the press was not intended to, and was not interpreted as, compromising anyone’s right to sue for libel - until 1964. In the unanimous New York Times Co. v. Sullivan decision, the Warren Court asserted that ">". . . libel can claim no talismanic immunity from constitutional limitations. It must be measured by standards that satisfy the First Amendment.” The Sullivan decision denigrated the right of certain people - politicians - to sue for libel. It did not denigrate the right of everyone, only politicians and judges. Which can be argued to be reasonable - but cannot be rightly said to be what the First Amendment requires. Sullivan decision is judicial legislation, not saying “what the law is.”

The Sullivan decision comes from the position that “the press” is weak and beleaguered. The reality is that, because it functionally is a cartel, “the press” is the core of the Establishment. As such, “the press” has exploited Sullivan to prevent the truth from prevailing over lies. The press reaction to the Kavanaugh hearing certainly should have told the Roberts Court that.

Republicans are the only ones who get libeled, and Republicans must sue for libel in the teeth of the Sullivan decision.

All that being said, half truths like the omission by CNN of coverage of Senator Graham’s opening monologue cannot be censored. IMHO.

Same with MSNBC. I watched some of the Republican response and questioning on FOX and out of curiosity switched over a few times. They had their usual suspects imitating a news team doing their usual hate Trump commenting, while a little box in the corner showed that testimony was in progress. I seriously doubt if any of their regular viewers bothered to switch over to C-Span to view it.
