Roberts has written the least number of opinions thus far (5). He is followed by Ginsburg (6) and Alito (6). Kavanaugh and Sotomayor have both written (7). Thomas, Breyer, Kagan and Gorsuch have all written (8).

This means that of the 5 cases to be decided, Thomas, Breyer, Kagan and Gorsuch are probably not writing. They have all written 8 opinions, and the court tries to keep the distribution of opinions equal.

Alito is almost certainly writing Mitchell. (That would take him to 7).

Either Ginsburg or Roberts (more likely Roberts) is writing Commerce (the census case.)

Roberts is almost certainly authoring either Rucho or Benisek (or both) these are the NC and MD Gerrymandering case.

Ginsburg could be writing one of the two above, or she could be writing Murphy.

If she’s writing Murphy, that bodes well for Commerce, Rucho and Benisek. If she is writing one of any of those, that is not good.

may she live as long as John Paul Stevens. He retired from SCOTUS in 2010 and we got Kagan.

It’s actually not difficult at the end to figure out which justices are writing which opinions, as all of the Justices typically write about the same number of opinions each term.

This term, the “magic number” would be 7 or 8.

Thomas, Gorsuch, Kagan and Breyer have all written 8, so we can eliminate them as authors as any of the final five.

The reason I think Justice Alito is writing Mitchell, is that he is the only one who hasn’t written for a case from the April sitting (other than Roberts) who I think is writing Commerce. Mitchell is also a criminal law case, and Alito writes many of those.

Since Roberts has only written 5 opinions, we know for sure that he has at least one of the gerrymandering cases (and maybe both if he writes a joint opinion) and he probably has Commerce as well.

That leaves Murphy for Ginsburg.

The Ginsburg - Roberts distribution is the most ambiguous, in this calculation. If Ginsburg doesn’t have Murphy, then she has either Commerce, or one of the Gerrymandering cases, which would be really, really bad.

They’ll issue their rulings then get the heck outta dodge.

If SCOTUS screws us on the census question, I suggest conservatives in blue states refuse to respond to the census.

Possibly, but not likely. He writes many of the criminal justice cases. Mitchell fits the bill for him.

RBG mentioned recently that the court would be issuing a number of 4-5 decisions split on ideological lines. Was this measured into your analysis? Since her statement I've only seen 2 cases Halleck and Township of Scott that were 4-5 splits.

The one case I'm most wanting is Commerce because I believe it is necessary for Alabama v Commerce (Congressional Apportionment including illegals) that it currently in the courts.

I think either is just as likely. What you say about Alito is true, but it’s also true that Roberts has demonstrated a willingness to give some of the biggest cases to Alito and I have some doubts that Roberts would want to be responsible for both the gerrymandering cases and the census case in the same term.

The only thing that is basically certain is that Roberts is writing about gerrymandering.
