Confirmed: The government can build the wall with Brian Kofage's GoFundMe money

.... DHS explicitly permits such donations at the directive level. DHS Directive Number: 112-02 Issued on February 11, 2008, “Gifts To The Department Of Homeland Security” explicitly states in Section V: “E. DHS may accept gifts to carry out program functions regardless of whether or not appropriated funds are available for that purpose, provided such expenditures are not barred by law or regulation.”...

There are regulations and laws that appear to prohibit donations but those involve situations in which accepting the donation for a specific purpose would thereby obligate the department to draw upon other funds in addition to the donated funds to carry out the project.

[UPDATE: An alert commentator on this article at Free Republic reminds us of President Ronald Reagan’s appeals for students to send in their pennies to restore the Statute of Liberty and Ellis Island. The private donations to save Lady Liberty were so extensive that “they wrote a book about it,” The Statue of Liberty: A Transatlantic Story. A private foundation raised $100 million towards the $230 million budget, of which $63 million came from corporate deals negotiated largely by Lee Iacocca. The Secure Fence Act of 2006 both authorizes and requires the building of physical barriers along the entire Southern border, except where the natural topography creates a physical barrier naturally. So in the 2006 law, “fence” is explicitly defined to mean “whatever it takes.” ... Fourth, GoFundMe ...is prepared to automatically refund donations if proper release of the funds is not confirmed, since donations are by credit card. . . .

This is not an authoritative source.

This is an attorney proposing an opinion that an argument could be made, or that you could probably get away with doing it.

He makes his living fighting such things out in court, so he has an interest in getting into a legal fight over it.

Its like the joke that this town is too small for a lawyer to make a good living - but two lawyers could make out well.

The bottom line is that Congress individually authorizes Government purposes that can use private money like donations (Statue of Liberty, Washington Monument, etc.). Democrats will likely not authorize donations for wall building, and it is NOT currently authorized, even if DHS has internal regulations that they are prepared to use them. That use of donations by DHS is explicitly “provided such expenditures are not barred by law or regulation.”. Well it is barred by law, unless Congress authorizes it.

Even back when I was a dimwit Democrat, I would not have opposed a physical barrier to protect our country from invasion.

The headline is completely misleading.

There still is no legal mechanism to spend GoFundMe money on a wall. It is unlikely that there will be, unless Nancy Pelosi agrees to authorize one.

You can’t be seriously looking at legality to build a wall. Legal mechanisms of governing collapsed a long time ago. If we were following laws and rules, the entire democrat party would be hanging from gallows.

No. The Government could not legally accept funds for those purposes.

Power of the purse is the Legislature’s main power to limit the actions of the Executive.

No authoritative source, such as the White House, Treasury, the Courts, the Legislature or DHS has said that the funds could be spent on a wall.

Legislators who have spoken on the topic have largely dismissed the approach as ridiculous. One guy (Congressman Warren Davidson) proposed enabling Legislation (HR 7207, that went nowhere). That explicitly acknowledges that there is no authorization now, and new Legislation would be needed.

Oh get real.

Courts were in session today, jails were operating, no politicians were shot.

The fact that crimes are committed does not mean that there is no functioning law.

Do you think that the House Democrats would not immediately impeach President Trump if he tried to illegally spend GoFundMe money on a wall without Congressional authorization?

That would actually be credible, defensible, legal grounds for impeachment under the Constitution.

Note: None of the GoFundMe money has gone toward building a wall. Why do you think that is?
