In an unbelievable travesty of justice, US District Judge Bernard Friedman dismissed a federal case against defendants charged with FGM and released them, saying that the 22 year old statute against Female Genital Mutilation is unconstitutional. Thirty other nations have outlawed the practice, but the judge says it has to be left up to the states.
Several Michigan doctors faced federal charges after subjecting about 100 under-aged girls to the barbaric practice of a Muslim sect. Two mothers were also charged under the statute. Judge Friedman released them, saying that Congress overstepped its bounds in creating the law in the first place.

“Judge Declares Female Genital Mutilation Law Unconstitutional”
Not exactly. He said the Constitution doesn’t outlaw it. Each state can make its own law prohibiting it. If, say, Wyoming wants to allow it, that’s their business.
A Ronald Reagan appointee.
He looks like he belongs in a horror movie.
“Each state can make its own law prohibiting it. If, say, Wyoming wants to allow it, thats their business”
That’s right! Just like we have for abortions and homo marriage.
Same should apply to baby boys, no circumcision. Intent is different but some similar results. Should be viewed as abuse.
Like RomneyCare, abortion, and marijuana, the law should be the individual product of individual states.
BTW: Ayaan Hirsi Ali wrote of her own FGM in Somalia, and said the cutting had no effect on her sexual experiences.
I know. Sometimes freezers who will argue states rights for days on a civil war thread, will come onto this thread and make silly statements.
The Federal Government has no business making this law. Most of us think Roe v Wade should be sent back to the states.
You cannot have it both ways.
(And this is not a post in favor of the practice. Its the most ridiculous cultural piece of crap that anyone could come up with.)
Give me an S! Give me an H! Give me an A! Give me an R!...
I could understand striking down the law but crying for joy, why that’s real impartial </sarcasm off>
I think the Judge is gay.....he also said how ‘they’ve’ waited so long for that.... most gays get emotional at a drop of a hat.
No. I meant going beyond what "already happened".
If that mutilation becomes illegal - then there is an ethical question about performing “transgender” surgery....they don’t want to protect innocents or they might have to protect the real sickos who are so confused they thing they need to disfigure themselves..which often leads to even more emotional/mental problems...gotta protect that....
And the judge made that clear in his decision, but still followed the constitution even though it lead to an unpopular result. Too many Freepers scream from their soapbox against activist judges, and then complain when a judge stays true to the constitution with a result they don't like. Dumb a$$es!
agree. He could have found a Constitutional right to FMG based on the right to privacy in the XIV Amendment.
