With jury selection slated to start next Tuesday, US District Judge Robert E. Jones suddenly moved today to dismiss two of the five counts against FBI Agent W. Joseph Astarita. Astarita is accused of lying about shooting at Oregon Standoff protestor LaVoy Finicum moments before Oregon State Police killed him.

Of course trying to kill LaVoy Finicum or Ryan Bundy, who was apparently injured by the FBI guy, not on the prosecutors agenda in this case.
If you read the article, it appears that the judge made a proper decision. Prosecutors almost always stack charges even when they know they are bullshit.
The judge has previously indicated he didn’t believe in the redundancy of charges but wasn’t going to do anything about it.
This is a reversal of what he said in a previous pre-trial hearing.
The judge said that the jury should have the final call even though the charges are redundant in a previous pre-trial hearing as I recall it.
At this point it’s us against them. The people vs the bureaucrats, prosecutors, state and federal agents.
So now as far as I’m concerned these creeps are guilty until proven innocent. The justice system is so horribly stacked against the public. There are so many laws that they can prosecute anyone and just stack up the charges to force a guilty plea.
It’s time for these crooks to get some of their own medicine.
A good jury can see right through a prosecutor’s attempt to stack charges. Judge did the right thing in dismissing charges that are duplicates.
You make a point that the general public does not understand.
They don’t realize how stacked the system is against the accused with the prosecutors able to squeeze until they get a conviction by stacking charges.
In the face of 300 years worth of jail time, the guilty pleas are extracted for 10 years lets say, and the prosecutors get to look good.
You say a “good jury” but to get a “good jury” you need big time legal fees for a “good lawyer” to get the “not guilty”.
The system is stacked against defendants in general and poor defendants even more so.
Jurors are confused and intimidated not understanding their ability to nullify.

That is true. Most jurors don’t think for themselves.
