If you read the article, it appears that the judge made a proper decision. Prosecutors almost always stack charges even when they know they are bullshit.
The judge has previously indicated he didn’t believe in the redundancy of charges but wasn’t going to do anything about it.
This is a reversal of what he said in a previous pre-trial hearing.
The judge said that the jury should have the final call even though the charges are redundant in a previous pre-trial hearing as I recall it.
