Breaking News: Jeff Sessions to Stand Trial in Cannabis De-Scheduling
Florida Marijuana Net ^ | Nov 2/17 | Robert Roundtree

Posted on 11/04/2017 10:01:41 PM PDT by free_life

For the very first time in history the United States Government will have to answer to the judiciary about the scheduling of cannabis and its unconstitutionality. Jeff Sessions, the DEA, and the DOJ will all have to stand trial according to the judge overseeing their case. This is the first time that a trial to legalize cannabis has proceeded past the normal attempts at dismissal. All of the defendants will have to get recorded depositions. This is great news for the plaintiffs in the case which include Army combat veteran, Jose Belen, former NFL player Marvin Washington, 11 year old Alexiss Bortell who uses cannabis to treat her epilepsy, Jagger Cotte. The developments are also welcome news for cannabis advocates around the country. If this lawsuit is successful, it would mean the scheduling of cannabis will be ruled unconstitutional and completely de scheduled federally. Some of the best quotes from the 80+ page filing in federal court can be found below.

Despite the relatively recent stigmatization of cannabis in the United States as a supposed ‘gateway drug’ used primarily by ‘hippies’ and minorities, there is a long and rich history of people from virtually every part of the world using cannabis for medical, industrial, spiritual, and recreational purposes,” the suit reads. “Indeed, those who have cultivated, encouraged the cultivation of, and/or used cannabis include, George Washington, Thomas Jefferson, John Adams, James Madison, James Monroe, Abraham Lincoln, John F. Kennedy, Jimmy Carter, Bill Clinton, and Barack Obama — an assortment of the most intelligent and accomplished statesmen in American history.”

Jose’s treatment providers at the Veterans Administration informed Jose that they are unable to prescribe medical cannabis because it is illegal under the CSA,” reads the suit, referring to Belen, the military veteran.

“We are seeking a ‘declaration’ to that effect, and also a permanent injunction restraining enforcement of the CSA as written, as it pertains to cannabis,” said Lauren Rudick, one of the plaintiffs attorneys. “The classification of cannabis as a Schedule I drug deprives individuals of basic constitutional rights, including Due Process and the fundamental right to travel. Some of these individuals, such as Alexis Bortell and Jagger Cotte (both plaintiffs in the action) are patients who seek cannabis as a means of life-saving medication. The government has a federal patent on cannabis, and has recognized the medical efficacy of cannabis in a variety of ways, yet Sessions is trying to reverse policy on cannabis use and contend that it has no medical use. It’s hypocritical.”

One thing is for sure, Jeff Sessions and the federal government will not go down without a fight.

Our neighbors to the north in Canada only had their rights recognized after challenging medical marijuana as a right through the courts. It appears this is how the Jeff Sessions legacy is about to be written. Instead of doing the right thing, his Justice Department will be forced to recognize the rights through the court system.

Marijuana has more than one medical use and who said anything about a pusher. It should be legalized for any purpose and taxed. It is far less destructive than alcohol, at least by an order of magnitude.

And, like alcohol, it teaches kids that something they ingest is the answer to their problems, not dealing with the problem itself.

That is the true danger of any drug.

Drugs don’t “teach” anyone anything.

Intoxicants have been around since mankind. Some are relatively harmless, some extremely dangerous. Some people are addiction prone, most are not. They can drink a glass of wine and do not think they should drink the whole cask.

Laws should be addressed to the latter end, the dangerous end, of the spectrum.

Is it not High Time for the People of this Country explicitly to declare, whether they will be Freemen or Slaves? It is an important Question which ought to be decided. It concerns us more than any Thing in this Life. The Salvation of our Souls is interested in the Event: For wherever Tyranny is establish’d, Immorality of every Kind comes in like a Torrent. It is in the interest of Tyrants to reduce the people to Ignorance and Vice. For they cannot live in any Country where Virtue and Knowledge prevail. The Religion and public liberty of a People are intimately connected; their Interests are interwoven, they cannot subsist separately; and therefore they rise and fall together. For this Reason, it is always observable, that those who are combined to destroy the People’s Liberties practice every Art to poison their Morals. How greatly then does it concern us, at all Events, to put a Stop to the Progress of Tyranny. Samuel Adams

Go easy.

I recently dabbled for the first time in maybe ten years. Either I’m much older than I thought or they are cross-breeding this stuff with mushrooms.

Good heavens.

The last time I visited Colorado a couple years back, my Sanders-voting schoolteacher brother pulled out a small bud he bought at one of the legal dispensaries. Immediately his entire garage smelled like thick wet skunk. Obviously, I didn't partake but I have no doubt that the stuff they're selling legally these days will have me drooling on the floor.

Honestly, when I stopped smoking weed, I had gotten to the point where I just really didn't like being high anymore. It made me fidgety, nervous, and I'd chain-smoke cigarettes (another vice I've since quit). Still, I want to try the legal stuff just once. I imagine after that, I doubt I'll smoke it again. I don't drink anymore either and I just don't enjoy the feeling of being intoxicated. Had plenty of that during my extended adolescence.

Nonetheless, I'll always support legal, recreational marijuana just on principle.

I use CBD oil made from real cannabis (from hemp is not as effective) as chronic migraine prevention. I believe there is a reason our bodies have so many cannabinoid receptors. For chronic pain CBD oil has been great. I take it a few drops a day under the tongue at bedtime. I have ZERO desire to be high and it doesn’t make you high. Children can take it. It does make you sleepy so I only take it at night. Oral, no cooking, it’s perfect for you if legal in your area.

I’m more or less in the same boat. If I have two glasses of wine at dinner, I’ll be in bed by 9:45. 20 years ago, 8 glasses of bourbon meant that I would want pancakes at 4 AM.

I have a neighbor with a friend who grows like 20 different varieties. The day Harvey cleared the area, she offered me something he had given her. After 4 days of worrying if my house was going to flood, it seemed like a good idea. 14 hours of sleep later......

Not legal, can’t even import it, is in legislature for this session, think it will go to Public for vote, as it would need State Constitutional alteration, the lottery did, as did Victims Rights, TN is 1 of the few states that put them into the State Constitution.

Ah, you’re in TN. Well, I’d like to move there one day so I do hope it is legalized there. It’s just an herb like many others that can be useful. I know some want to get “wasted,” but that is their own business. I’d like them not to drive high and I’d like people not to drive drunk, but it still happens.
