Trump Nominates Church/State Separation Denier for Federal Judgeship

Among Donald Trump‘s many nominees to federal judgeships yesterday was Jeff Mateer to be a U.S. District Judge in the Eastern District of Texas.

Mateer used to work First Liberty Institute (formerly known as Liberty Institute), the conservative legal defense group. The problem isn’t (merely) that he’s a conservative judge. It’s that he doesn’t give a damn about church/state separation.

In 2013, during a conference at the University of St. Thomas in Houston, he even challenged students to find the words “separation of church and state” in the Constitution:

… what I often do when I speak to children in schools, even college students… I’ll hold up my hundred-dollar bill and I’ll say, “For the first student who can cite me the provision in the Constitution that guarantees the separation of church and state — verbatim — I’ll give this hundred dollar bill… It’s not there… The protections of the First Amendment were to protect us from government, not to cause government to persecute us because of our religious beliefs.

Ok, first we had climate change deniers, now we have church/state separation deniers.

In reality, what we have are liberal/socialist worldview deniers. Gasp! You don't say!!

Church/state separation. Where is that in the Constitution exactly ? Can’t seem to find it.

Even though he can’t find “separation of church and state”, the author ignores what is actually in the constitution.

Article VI of the Constitution says that ..”no religious test shall ever be required as a qualification to any office or public trust under the United States.”.

The judge’s religious view are irrelevant to his nomination.

I've read through the constitution and I just can't find the part where it says their must be a "separation" between church and state. Can someone help me out with this?

There seems to be a consensus among the legal profession that materialism is the official state religion of the United States but there was once a similar consensus that a black man has no rights that a white man must respect. Legal consensus tends to change over time.

That means what Mateer is really saying is that he plans to be an activist judge /who doesn’t give a damn about precedent. He wants to create laws from the bench

Funny how liberals have a cat when a conservative judge makes law from the bench....could care less when liberal judge does it!!!

The false concept of separation is a perversion of Thomas Jefferson’s letter to the Danbury Baptists. Some obviously don’t like it but there is no separation of church and state.

In this case, it does not appear that the judge will be making law from the bench. It appears only that he is aware of what the Constitution actually says, and will rule on that basis.

I guess “denier” joins “racist” in the category of ultimate shutdown words. When you get called one of these two words the discussion is supposed to end with the recipient of the epithet hanging his head in shame. I suppose it was inevitable. Denier was a useful word for those who trivialize the genocide of European Jews and it is way overdue to become a general term of opporbrium for use in any dispute about anything.
