Rosenstein's Authorization To Mueller (ray76)

Rosenstein's authorization memo appointing Mueller does not state the grounds for the authorization:

• what violation(s) of law are suspected
• what evidence exists to support those suspicions
• a time limit for the conduct of the investigation

Instead the authorization memo grants an unlimited amount of time to investigate any individual associated with the campaign and any "link" they may have with the Russian government - or - any matter that arises during the investigation. It is a completely wide open investigation yet no violation of law is alleged.

The U.S. Code of Federal Regulations requires that a special counsel not be appointed unless and until it is determined that there are grounds for a criminal investigation. 28 CFR 600.1

Excerpt of the authorization memo:

(b) The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James 8. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017, including:
(i) any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump; and

(ii) any matters that arose or may arise directly from the investigation; and

(iii) any other matters within the scope of 28 C.F.R. § 600.4(a).

(c) If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from the investigation of these matters.
Rosenstein’s authorization to Mueller cites Comey's testimony, “The Special Counsel is authorized to conduct the investigation confirmed by then-FBI Director James B. Corney in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017...”

Comey in testimony before the House Permanent Select Committee on Intelligence on March 20, 2017 explicitly and unambiguously described a counterintelligence investigation of alleged Russian interference in the 2016 election. Comey testified that the investigation includes the DNC's "hacked" e-mail systems and the "leaking" of those e-mails. Why is this not included in Rosenstein's authorization memo?

Recent evidence shows that DNC contractors had access to DNC e-mail systems. These contractors have fled the country, except one who was arrested while fleeing. It's entirely possible that these DNC contractors are the source of the "leaked" DNC e-mails and that Russia had nothing to do with it. Why is this not being investigated?

Why does Rosenstein exclude from investigation of alleged Russian interference in the 2016 election the activities of individuals associated with the Democrat candidate, such as the DNC and their contractors? The allegations of Russian interference began with the alleged Russian "hack" of the DNC e-mail systems. Why is this not investigated? Why has the DNC refused to allow investigation of the e-mail systems?

Why is Rosenstein's authorization confined to only the Republican candidate? What evidence is there to support the allegation of a "link" between the Russian government and any person associated with the Republican candidate? Why aren't persons associated with the Democrat candidate investigated for any "link" with the Russian government? Or any other government? Why aren't links between the Clinton campaign and the Ukrainian government investigated, for example?

Again, Comey testified that there was a counterintelligence investigation of alleged Russian interference in the 2016 election. Rosenstein authorized Mueller to conduct that investigation but then confines the investigation to only individuals associated with the Republican candidate. Why?

Why are individuals associated with the Democrat candidate excluded from investigation?

The integrity and impartiality of this investigation might reasonably be questioned.

I am in the process of filing a complaint with the inspector general of the Department of Justice. most of what you outlined and mostly taken from andrew mccarthy’s article a few days ago.

The correct course of action beyond the public relations and political angle is the legal one. Trump's attorneys need to block access to all attempts to subpoena or immunize any witnesses whose testimony or evidence clearly lies outside the scope of the Russian "election tampering" investigation.

If the courts rule against him, he loses nothing by doing this. But if he can file to successfully get injunctions against Mueller he would be able to limit the scope of Mueller's investigation if Rosenstein will not.

Great points.

Also Comey admitted illegally leaking to get an “independent” counsel appointed. This was illegal. So the whole grounds for creating the independent counsel were illegal.

My view is the independent counsel appointment should be declared invalid to get rid of the independent counsel. Then there would also be no need to “fire” the independent counsel, the independent counsel would be removed based on invalid appointment, he was never properly authorized or legally created.

Looks like this thread needs to go to McGahn and Trump’s other lawyers. The Whitehouse.gov email address doesn’t seem to work presently, it is taking one in a circular loop and not allowing the submission of emails. Had worked fine before but they apparently changed the whole format. Possible sabotage from the inside intentionally given everything going on with the leaks and all.

Sessions recused himself from the Russia Election probe. If Mueller moves on to Trump business deals, then Sessions is no longer recused and can reel this thing in.

It is a witch hunt, that was its intent. Trump the outsider disruptor is messing up DC’s nice little world with politicians, lobbyist and cash. They call Trump a populist. I like that term as it shows popular.

DC is a small area, and that is the key objective for CW2

There is no 28 CFR authority for a special counsel to conduct a ‘counterintelligence investigation’ There was no crime to investigate. The authorization is invalid.

The reason it worked out the way it did is that Republicans are always scared of whatever and running away from their shadow. They have no sense of outrage and willingness to stand up and fight with regard to corrupt Democrat maneuverings. It is hard to know whether it is because of stupidity, passiveness, or complicity, but they always end up being whipped. This special counsel fiasco is perhaps the biggest “shoot yourself in the foot” jewel of all time. As it stands right now, Sessions epitaph will read: “The man who triggered the impeachment of President Trump.
