Fields has managed to get Lewandowski charged with misdemeanor battery, which under the law is simply an "unwanted touching." The charge is usually leveled when someone commits a fairly-egregious act of "touching" (like punching you) but does not cause great injury in doing so. That is, while the letter of the law may be met here the clear intent is most-definitely not.
Never mind the better question: who was initiating the touching?
Second, there is apparently a member of Trump's Secret Service detail that has confirmed that Fields touched Trump twice before Lewandowski intervened and Fields was warned to stop doing so, which she ignored.
Further, the video I've seen doesn't clearly support the charge and the alleged "bruises" are in the wrong place to have been caused by any contact that could have occurred in said video.
Finally, Fields claims she was "tightly grabbed" and "yanked down", with the explicit claim that Lewandowski attempted to "forcefully throw reporters to the ground."
From the video evidence that very clearly did not occur.
In other words the allegation was a lie.
What is the penalty for filing a false police report? This sort of "touching" happens every time you're in line at a stadium or get on a subway car. As I said when this story first broke and other video was available there was simply no evidence to support the original claim, and now that we have an overhead view my perspective on same has only been strengthened and major media personalities are coming out of the woodwork to agree.
DEFENSES TO MISDEMEANOR BATTERY
Battery is one of the most defendable charges in all of criminal law. Some of the most common defenses include the following:
Self-Defense;
From:http://www.husseinandwebber.com/crimes/violent-crimes/simple-battery/
Defense of Others;
Defense of Property;
Consent (touching not against alleged victims will);
Mutual Combat;
Use of Force under Floridas Stand Your Ground Law;
Accidental Touching;
Touching Incidental to Other Conduct not Aimed at Making Contact;
Other Factors or Motivations Showing Lack of Intent;
Lack of Evidence or Conflicts in the Evidence.
NON-DEADLY FORCE IN DEFENSE OF OTHERS
Under Section 776.012, Florida Statutes (Floridas Stand Your Ground Law), a person is justified in using non deadly force against another when and to the extent that the person reasonably believes that such conduct is necessary to defend another person (a third person) against the aggressors imminent use of unlawful force against that other person (third person). There is no duty to retreat.
“...One thing we know now for sure, Lewandowski lied about never touching Fields, Trump’s own video proves it!”

Yes, and the video also proves that Trump himself lied when he said Fields “made it up”.
It IS a Trump property security video, but it wasn’t released by Trump—IT WAS RELEASED BY THE POLICE. The police would have received it by subpoena as part of their investigation to determine whether charges were justified.
Define blather. See above.
Notice Trump is pulling away from Fields.
Notice that Fields is impeding two security agents who have to hustle around her to maintain the cordon around Trump.

Many ways to say it, but it would be hard for me to work up any sympathy.
‘’Although you may be correct on the subpoena bit, there is no evidence that is true from the article.”
*********************************************************
True dat -— I’ll grant you. The Trump property managers could have voluntarily given it over. But any good attorney would advise them to request that the cops first obtain a routine subpoena specifying what they were looking for (a standard precaution to keep some agenda-driven cop from going on a “fishing expedition”).
Thanks and may God bless you too Laz.
I agree. Reducing the ambitions of young women to an overnight hotel stay was pretty grubby. The tattoo could have at least been permanent.
Seems the Secret Service let Fields put her hands on Trump after the interviews were over. Fields could be charged if Trump pressed charges.
I don’t see any evidence that she was pulled backwards, although it looks like the Secret Service did seem to be behind her and may have touched her arm when Corey cut through in between Trump and Fields.
No violation that I can see, just a crowded room and a Celebrity being ushered out of the room.
Am I seeing this right? She put her left arm up, probably to touch Trump (did he really say on the rump?), agent in foreground closes in on Fields, Lewandowski moves up and between her and Trump, I do see Lewandowski appear to touch her arm because she had it extended, there’s nothing brutal, Lewandowski moves on through, looks like she backs off, was probably ordered to.
However, like his boss, no apology ever and begins the name calling and attempt publicly to smear her.
That kind of thing simply doesn't need to be done but the total tone deafness of Trump where the word humility never enters his mind, brings about stuff such as this.
So why doesn’t ole bone spurs press charges?
Agree 100%. Most STUPIDITY such as this is totally unnecessary.
Trump had control of the video for several days. He could have had it eliminated at any time. No word on how they received the video. The fact that they would even investigate this nonsense shows that Florida has no real crime left to investigate.
Ms. Fields like so many ‘professional’ women want to be treated as equals until they are actually treated like equals. Then they cry foul. Ms. Fields better toughen up if she wants to piss in the tall grass with the big dogs.
Perhaps she has Hemophilia.
Just after the video begins, it looks like Trump quickly pulls his right hand away from Fields and puts it on the left side of his chest, as though he is trying to get his arm away from her. I suspect that she touched his arm, or he would not have responded like that.
Lewandowski apparently noticed what she did and responded quickly, and I think appropriately, to move her away from Trump. Members of the press should keep their distance from the candidate, and certainly should keep their hands off the candidate.
The video shows clearly she was not "almost" thrown to the ground. Lewandowski slowed her down, and moved her behind Trump. Good for him.
What a security nightmare that crowd was! Too many people too close to the candidate!
It is ridiculous for her to complain about the way she was treated. Piers Morgan, for once, is right: Any male reporter who made the same complaint would be a laughingstock.
It should be trivial for a lawyer to get this charge dismissed.
Trump says he's sticking with the guy - Cruz says he would "ask him to step down".
Who would you trust through thick and thin??????
GO TRUMP!!!!!!
Let’s not also forget WAPO reporter, Ben Terris, who gave eye witness testimony on audio, as it happened, said that Lewandowski almost threw her to the ground.
Liars both...
