Historically, many Supreme Court nominations made in a Presidentâs final year in office are rejected by the Senate. That started with John Quincy Adams and last occurred to Lyndon B. Johnson.
It is critically important that the Senate hold pro forma sessions, since President Barack Obama would be able to make a recess appointment to the Supreme Court if the Senate goes out of session. Currently, there is a five-day recess this week and a two-week recess scheduled for April. There have been twelve such recess appointments to the high court. A recess appointment would last until the end of the Senateâs next session.

This year the democrats have only 10 senate seats up for reelection. The republicans have 24 senate seats up for reelection. There is only a 5 vote lead by the republicans, iirc. Odds are that the senate will change hands.
If the new senate is seated on 3 January and Obama doesn’t leave until 20 January, the republicans better damn well hope they can hold onto the senate.
They can appoint a new Scotus justice with the majority and 2.5 weeks to work. They would have to go nuclear, but they will.
If the Rats are able to put another liberal on the court, you can expect to kiss the 2nd amendment goodbye.

In 2010 & 2012 the GOPe promised to get rid of Obamacare. They lied. In 2016 they promise to hold off until the new president is sworn in. How could anyone believe them? Lifespans were much shorter back then. I don’t know how they could have foreseen our longer lives today. All in all, I think they did a phenomenal job ~ not sure anyone alive today could even come close.
I read somewhere else tonight that if McConnell caves and okays an Obama nomination then Ginsburg will quickly resign for health reasons so Obama can nominate another because there is no one to stop him. I could see that happening.
