I was told today that Ted Cruz's conservatism was moot because he is not eligible to run for president. I have also been told by others that true conservatives cannot win a general election. If that is true, then there is no winning, for even if you prevail by sacrificing values and principles to enlarge your "tent", you have won nothing.
The truth is, regardless of Cruz's status, Cruz's conservatism is not moot anymore than the Founders ideas were moot. For if values and principles are moot, you can follow the law precisely and you have nothing. The Founders parted company with the law they were under to embrace freedom. If it takes another revolution, so be it. And if we have to start over, I don't care where the values and principles and morals come from if they are good. I will stick with invisible virtues wherever they be found. If they are not embraced by Americans in power, I will support a foreigner who has them. I believe we are that point in history. This view, I was told, was a rejection of the Constitution. My response was not my one, but one of the Founders:
"The question you propose, whether circumstances do not sometimes occur, which make it a duty in officers of high trust, to assume authorities beyond the law, is easy of solution in principle, but sometimes embarrassing in practice. A strict observance of the written laws is doubtless one of the high duties of a good citizen, but it is not the highest. The laws of necessity, of self -preservation, of saving our country when in danger, are of higher obligation. To lose our country by a scrupulous adherence to written law, would be to lose the law itself, with life, liberty, property and all those who are enjoying them with us; thus absurdly sacrificing the end to the means.. . . " - Thomas Jefferson to John B. Colvin, 20 Sept. 1810 Works 11:146

Only thing I can find in NH State Court is this Booth v. Cruz (https://dockets.justia.com/docket/new-hampshire/nhdce/1:2015cv00518/43524), I have no idea what it is about.
No. I never stated that we do not exhaust all legal options before we stand for what we believe. Jefferson did not say that. He said, basically, there is a time when righteousness is above the law. Go back a read what he wrote again, if you read it the first time. It is profound.
You quoted a selected portion of Jefferson’s letter to justify Cruz’s candidacy.
That one is some form of civil rights 1983 claim, deprivation of rights. That case is toast.
Thank you!
It could be both!
Vanity 99 on this topic
You don’t care anymore yet post a vanity on it
I’m feeling Joe Wilson vibe
Indeed it could, but I don’t think so. I think at least some of them know. One of those open secret things, at least in the office.
They seem to be concerned with “dotted i’s and crossed t’s” on the paperwork

What Jeffersom wrote applies accross the board. Cruz was not born at the time Jefferson wrote that. I do not know if Cruz is “the guy” we need. I very seriously doubt any of the others are. Jefferson wrote what he wrote. It means what it says. I agree with Jeffersom. This is not just about Cruz. Our Constitution has been subverted, and either you are going to submit to the subversions (plural) or there is coming a time of civil disobedience in favor of the intent of the Founders. Our government has become “ King George”. What are you going to do about it? — play by the rules they use to keep you in bondsge? Thry have supplanted the Constitution and are using the same against you because you respect it.
Yeah, except they also wouldn’t allow a non-human, or somebody 20 years old to get on the ballot, so they are checking something. They single out NBC as being beyond their ken. Playing dumb. You try that when you do something wrong.
I don’t care, and want others not to care also — so take that!!! : )
Maybe letters to the editor or something, calling them out by name, as a disgrace. They put unqualified candidates on the ballot by feigning ignorance. Perpetrating a lie and fraud on the public. It is a crime, by the way, to submit false statements on the Certification. I don’t know who is responsible to file those complaints, or if the public can do it - and I don’t know who is responsible to handle the complaints, DA probably.
Jefferson was, as usual, right in that magnificent quote.
By analogy, SCOTUS invented out of whole cloth a "right" of any mother of an infant in utero (in conjunction with her "doctor") to murder her unborn child at any time for any reason during the first two trimesters of pregnancy. Not a word in the constitution or its amendments supports this barbarism.
Finally, when the usual gang of political suspects rolled over and played dead for years claiming to oppose abortion but, golleeeee, what could they do since SCOTUS in their warped imaginations can amend the constitution at will and especially when the alternative is $$$$$$ minded Congresscritters having to risk alienating some voters by enforcing Amendment XIV, some small number of mostly Christian patriots took matters into their own hands and ran a series of "hit and run" raids on abortion mills (Operation Rescue, Pro-Life Action Network and some independent groups), preventing scheduled murders of babies, de-sterilizing everything in sight (in the more militant direct actions), breaking raw eggs in into the killing suction machines so that they would have to be rebuilt. Sometimes, the targeted abortion mills were closed for weeks afterwards.
Legal defenses to Rescue prosecutions included the common law and sometimes statutory defense of "necessity" which Jefferson references. Also, vicarious self defense (defense of another). Also that abortion had been deemed a "crime against humanity" by the post WWII Nuremberg trials in which the USA prosecuted and also provided some judges including SCOTUS Justice Robert Jackson. The Nazis infamously defended that they were only obeying Germany's laws or Hitler's orders to no avail as it should have been. What was then a crime against humanity can hardly be regarded as a constitutional right.
When do we stop allowing the enemies of our civilization to bring machine guns to a fistfight when we are unarmed. I cannot imagine this faux "constitutional" prissiness in which generally conservative people are arguing for unilateral political disarmament at a time of such constitutional emergency as we are living through.
I would very reluctantly vote for Trump IF he is actually nominated but I will be holding my nose since he is nothing vaguely resembling an actual conservative. Once Scott Walker left the race, there was only Ted Cruz as a totally reliable constitutional conservative. Rubio has disqualified himself politically over the immigration fiasco but he has a 96% conservative voting record.
If Trump keeps up these asinine attacks on Cruz's eligibility, you can look forward to POTUS Hillary or Bernie. This crap pisses off people he will NEED as voters if he should be so fortunate as to be nominated. The mere facts that he is infinitely superior to the moral monster Romney, that he talks dirty, that he has no manners, that he thinks THE WALL and RTKBA and a few other stands are a sufficient substitute for the wide range of conservative issues.
Thanks for the great Jefferson quote that reminds us of the mindset of our Revolutionary forebears.
God bless you and yours!
No offense, but it doesn’t matter what you, I or anyone Posting here thinks. We are not Judges in a Court of Law.
I keep reading all the wasted Keystrokes blaming Trump for making this an issue, but it doesn’t matter what he thinks either. Cruz has brought this upon himself, putting a Bullseye on his back so to speak.
The DemoncRats have been waiting with baited breath for the moment to pounce on Cruz’s Eligibility, starting with DemoncRat Allan Grayson but probably before even he mentioned it way back when.
As far as I’m concerned, better to get it out of the way during the Primaries rather than being an issue with a run up to the General Election. Obama has way too many Liberal Judges in his arsenal for us to think that there won’t be a problem if Cruz becomes the Republican Nominee.
I am a Cruz guy, but I think he underestimates the enemy, and by Enemy I don’t mean any other Republicans running against him. Just because he says it isn’t an issue, doesn’t make it so, it is stuck to him like white on rice.
People compare this to Obama and dismiss it out of hand, but Obama was Born in Hawaii to a United States Citizen Mother. Cruz was not born in the United States although his Mother was a Citizen as well.
Now we hear Cruz’s Mother may have had dual Citizenship due to her allegedly Voting in a Canadian Election.
Rehashing this on multiple FR Threads doesn’t move the Ball one inch down the Field. The chips will fall where they may.
Just to be clear, I believe Cruz is eligible, but my handle here is Kickass Conservative, not Attorney General Kickass Conservative or Judge Kickass Conservative.
Just my $.02, your Mileage may vary.
No offense, but it does matter what I think and what everyone else thinks, personally and as a nation. The nation is the sum of its people. If you wish the courts of law, judges, and politicians to be your soul and conscience, that is your decision. Me, I will weigh all things, think, and decide what I as an individual believes in and will proclaim it. So for me, and a lot of other individuals who maintain sovereignty over our own souls, it matters.
It’s a dead issue. His mother was born here. The problem was we don’t even know if obama’s mother is his mother.
No, I don’t wish that any Government entity become my conscience or take my Soul away from me. I didn’t say that or imply that in my original Post.
I am speaking about whether Cruz is qualified to run for the Office of President under existing Law. Nobody in Political Power is reading FR Vanity Posts and changing or enforcing the Law because they were enlightened by the deep thoughts and discussions we partake in every day.
If Cruz doesn’t qualify under the Law it doesn’t matter what you or I wish, how we feel or what we think about it, he will not be Sworn in to Serve as POTUS.
Outside of taking up Arms, you and I will just have to live with it. We don’t live in a Country where “as FR goes, so goes the Nation”. Our only weapon is our Vote and trying to convince others that our positions are worth supporting.
I am not being flippant, just stating facts.
