Gov’t to creamery: Your milk is entirely too natural to not be labeled “imitation”

Sometimes government’s dishonesty, incompetence, wastefulness, and misguided nannyism combine to make a perfectly ridiculous story. Today’s comes to us from Florida, where the Ocheesee Creamery is being forced to dump gallons upon gallons of good, natural skim milk because the state is requiring the business to label its good, natural skim milk “imitation” because they haven’t added anything to it.

Paul and Mary Lou Wesselhoeft have been fighting this in federal court with the Florida Department of Agriculture and Consumer Affairs, which had formerly allowed them to sell their skim milk while calling it skim milk. No one seemed confused by this except the state government, which changed its requirements.

The Institute for Justice is helping the Wesselhoefts take on the state, arguing they should not be prohibited from telling the truth about their product.

This is from the government that now allows products like “Non-fat Ice Cream”.

Is it any wonder it has no idea of what marriage is?

Well, Florida is the government running this disaster, not the USDA, which caused a meat-processor farther down in the story to shut down.

Although confusing, I think the gov’t has a reasonable point:

Americans don’t realize that skimming milk removes the vitamins. Typically, milk processors add the vitamins they remove right back in. These people do not. Hence, the government doesn’t want them to call it milk, and therefore not skim milk.

A “reasonable” solution would be for the government to say, “fine, you can call it skim milk. But you also have to put a warning label which says you’ve removed vitamins without replacing them.”

Yeah I got swindled a few weeks back when I bought “Non-fat Half & Half” that was misleadingly labelled. Silly me, I assumed there was no such thing, since one of the “halves” is cream! Now I am careful to look for the fine print.

I see... “milk” has been redefined to be not pure milk, but adulterated milk.

Similar things are happening with citizenship.

Yeah, that seems reasonable, but the government seems to have rejected an offer like that.

Another reasonable solution would be to let these people call their product “skim milk” and have the other producers call their product “Vitamin A fortified skim milk”. That would be the most accurate labeling, I think.

A reasonable solution would be to get the government out of private transactions. Caveat emptor has worked for thousands of years.

Another reasonable solution would be to let these people call their product “skim milk” and have the other producers call their product “Vitamin A fortified skim milk”. That would be the most accurate labeling, I think.

Strangely enough, the Federal rules seem to take this approach - if you add vitamins to milk (including Vitamin A), you need to label it as such. Not sure what Florida thinks its doing here...
