I live in South Dakota and used to live in Minnesota. Really not a lot to do in the winter. He’s on an oval, how much trouble could he cause?

Oh. I’ve seen them. Those things glide slowly over the ice. That sounds like something that happens today in a much smaller scale. Most everyone has seen photos of dogs or cats hitching a ride on a Roomba robotic vacuum cleaner.

There’s the problem right there. 0.314 is well below the legal minimum to operate a Zamboni in North Dakota. Get another six-pack into that man, stat!

Public road has a legal definition in any state. I can drink from the bottle and drive around my yard all I want, and I can let my 8 year old drive, too, subject only to child endangerment laws. Unfortunately, the automobile and the coming of public roads, instead of horse trails, gave government an excuse to put all kinds of conditions on people who traversed those roads. Those laws don’t apply on private property. Whether they apply to publicly owned lands, like a rink, would depend on how the law of that state defined a public road for purposes of licenses, DUIs, speeding, etc.

Defense attorney Lindsey Haugen said Anderson wasn't guilty because North Dakota state law doesn't define a Zamboni as a vehicle.

Yeah, but the judge studied his mug shot and decided he had bit the pavement after exiting his vehicle on the way to work.

I looked up the Fargo Zamboni case, seems ND law is structured such that DUI applies on operation of a motor vehicle, ANYWHERE. Must be similar in Minnesota (another Zamoboni DUI incident), but can't happen in New Jersey.

Fargo Police Lt. Joel Vettel said even though the arrested Zamboni driver was not on a public street, North Dakota law dictates anybody operating a motor vehicle while heavily under the influence of drugs or alcohol be arrested.

Anderson follows in the footsteps of Joel Bruss, who was arrested in Apple Valley (Minn.) three years ago after his board-smashing Zamboni driving caught the attention of, well, everybody. Bruss had a blood alcohol level of 0.32, and ultimately was sentenced to two years probation. But eight years ago, a New Jersey judge ruled that, in New Jersey at least, there was no such thing as Zamboni DUI.

The statute on drunk driving in North Dakota states:
39-08-01. Persons under the influence of intoxicating liquor or any other drugs or substances not to operate vehicle

1. A person may not drive or be in actual physical control of any vehicle upon a highway or upon public or private areas to which the public has a right of access for vehicular use in this state if any of the following apply:

An ice rink is not a "public or private areas to which the public has a right of access for vehicular use".

I agree. The only way I could see it being illegal is if
it’s considered a motor vehicle. It is illegal to ride a
bicycle drunk in North Dakota.
