This discussion of nondisclosure statements could also be applied to the civilians in Ben Gazi.
After wading through that article, I’m ready for a Translation App. that would interpret that which resembles legalese. The money quote is NDA signed under duress are not valid.
Who are these Generals? Who had knowledge? Where are they? Let’s start outing the chain of command.

If it is a “contract agreement” someone needs to provide the “consideration” aspect for me.
It has been quite interesting to see how often this administration has prevented embarrassing information from coming out by getting federal employees to sign after the fact NDA’s. Benghazi is another example. You are exactly right - what was the consideration? I am aware of NDA’s after the fact in employment situations - but there was something of value provided to keep the employee quiet - a raise or something. Private companies can do that sort of things - private matters.
In the current administration’s case it is becoming more apparent than ever that they are either just intimidating the hell out of people with unenforceable NDA’s or they are using our tax dollars to in essence bribe federal employees to not divulge information that should be divulged - at least to Congress. This all stinks.

Most tech companies make you sign those when you join up in the engineering area. So I do not agree that his argument holds for forced signing.
example: Anything you work on at ARC Technologies does not get mentioned to anyone else after you leave. It does not mean you cannot work at another technology company of course.
I would say this from my twenty years in the Air Force. NDA’s aren’t typically laid out for people to sign. Out of a hundred folks....you might have twenty that have to sign one in their whole career. If you have a higher security clearance....you might be signing one every five years. In this case....since nothing is really classified...I’m wondering of the trigger necessity to make NDA absolutely necessary.
I’d take a guess that a dozen officers are at fault. Some knew Bergdahl was an idiot and should have sent him back to the states prior to the event. Some likely felt the whole story would get out and discredit their career.
If, as has been reported, he’d tried to walk away/desert once before, why oh why wasn’t his sorry ass shipped home at that time..
I think the main reasons why the enlisted aren’t afraid is they are likely completed with their contract obligations. In my day, that was 6 years.
For officers it’s a different story. It is not beyond the realm of an officer having left the military to be called back up to active duty (and punished as would likely be in an Obama world).

How is one assigned to an airborne unit (and the 501st is certainly one of those) without being airborne qualified? Good catch!
Used to be, back in the day before lawyers ran the military instead of merely supporting it, that an order from an officer, either verbal or written as policy, was all that was required to accomplish this task. Now soldiers sign NDAs as corporate employees do, making it even more difficult for a soldier to take a situation like Bergdahl's up the chain of command for resolution without fear of retribution. Another reason our military has its collective nuts in a vise.
Curiously enough, Stanley McChrystal took over command of all US and ISAF forces 10 days prior to Bergdahl's desertion.
A few years earlier, McChrystal had a (pretty significant) hand in the Pat Tillman cover up and it was in fact, McChrystal who signed off on Tillman's Silver Star.
Adding another wrinkle into the mix, Michael Hastings penned the Rolling Stone article that got McChrystal booted from his Afghanistan command in 2010 also was among the first in the media to explore the circumstances of Bergdahl's desertion.
All coincidence, no doubt.
Taken as a PFC, probably at the end of Basic/AIT and before attending Airborne School. Soldiers enlisting with ultimate assignment to an airborne unit will wear their maroon beret for their post Basic Training glory photo, regardless of whether they have already earned their wings. It’s a common practice.
