Cop: I'd Love to 'Bang down Your Door and Come for Your Gun'

And to a poster named Cameron Smith, Peterson said, “I give my left n** to bang down your door and come for your gun.”

Of course, the conversation had become heated, causing Peterson to perhaps speak a bit more rashly than he would otherwise. And I’m well aware of the “good soldier” cop argument stating that theirs is not to wonder why, theirs is but to do or die (even if it kills constitutional rights). Hey, “I don’t make the laws,” says the dutiful constable, “I just enforce them.” But there’s a problem with this position. And this is why I want to give you, my friends in law enforcement, the reasoned, moral argument for “policeman nullification.”

Even good people can live lives of contradiction and entertain ideas that simply aren’t true. For instance, if you’re a cop, it’s easy to justify an action by saying that your job is only to enforce the law, especially since, on paper, this is certainly so. But the implication that you enforce every law, across the board, every time, without discretion is absolutely untrue and you, I and everyone else knows it. You don’t ticket everyone driving 31 in a 30 zone, and many times even more egregious law-breakers get off with a warning. Some laws aren’t applied at all, such as a parking law in my town an officer told me was on the books but that “we don’t enforce.” You use discretion all the time.

Thank you for your earlier support laotzu. For the record, here is how I "defended" the officer.

Post #40 - A friendly suggestion for Cinque. Since he is not going to comply with the law, he should be proactive and not reactive. He should file a complaint with the internal affairs division at the officer’s department. He should also retain counsel to accompany him when he gives testimony and signs a complaint. After that, he should file a lawsuit. Anyone who has had such a thing said to him would be reasonably in fear of being targeted for a search warrant, or would worry of being retaliated against for other matters. Start the fight now, strike first, don’t wait!

Post # 45 - The officer made a foolish statement, but as yet, neither he nor his department has done anything to Cinque. So until something actually happens, is it ok with you if the officer gets home safe?

Post #74 - I stand with the people who did not like what the cop said to Cinque. But, as the cop has done nothing, I want someone to legally or morally justify an opinion that he should not go home safe. It’s just that simple. It is unfortunate that you are so confused on where I stand.

Post #225 - Once the name calling and general silliness began I decided to end my participation on this thread. But because I have a high regard for your sense of humor and your intelligence, I will be back for a while.

Here is my basic position on this:

1. I neither like nor support what the cop said to Cinque.

2. I would like for Cinque to be pro active, and not wait for the cops to do something. I want him to take the fight to them, but by legal means.

The whole debate was not because I was defending the officer, it was because I asked why he didn't deserve to go home safely. At the time, the information was not known to me that his statement was an on-line comment, and not one which was delivered face to face. Had I known that it was an on-line comment, some posts might have been much different.
