Deputy killed as SWAT Team breaks through door to serve “No Knock” warrant

On December 19th, a sheriff’s deputy was shot and killed during an attempt to serve a “no knock” warrant near Sommerville, Texas. Just before 6:00 A.M. an 8 member SWAT team broke through the door of Henry Goedrich Magee to serve a warrant which would permit the team to search the mobile home in which Magee and his pregnant girlfriend were living. Reacting to the pre-dawn, forced entry Magee grabbed a rifle propped against a bedroom door frame and fired at the unidentified intruders, killing 31 year old sheriff’s deputy Adam Sowders. No one else was injured and Magee was taken into custody. He is being held on $1 million bail and has been charged with capital murder, punishable in Texas by life in prison without possibility of parole or death by lethal injection.

These are the broad facts of the case as first reported by a number of print, radio and TV sources. The following additional information has been made public during the past few days:

Do you have any reason to believe a verdict in this case would be reasonable?

Today, who knows.

What I opined is what I thought reasonable would be in this case as presented.

Some of them were probably crapping their pants-somebody dared shoot at them ? ;also the dying deputy’s body may have interfered ?

And maybe every lawman is not as ready to shoot as the leaders dressed up to play army?

No knock raids ,and asset forfeiture without related criminal convictions, are two horrible reasons why the War On Drugs always was, and always will be , a very bad idea .

Cops have forgotten that no-knock entry was intended only to prevent evidence from being destroyed.

Actually, that was the excuse they used to justify NKW's.

Reva was unopposed in the General election and was declared re-elected as the 335th Judicial District Judge.

I’ll be the first to say a prayer for the cop. I’m sure he was a great guy, good family man and will be buried as a hero. Now that that’s out of the way...

Don’t bust down my door in the middle of the night. Or you’re gonna get a load or several, of buckshot, center mass.

I don’t know what the score is...probably 100:1 homeowners killed to cops. And I’m supposed to feel sorry for this guy. No Thanks. They, he, brought it on themselves. I’m just suprised the guy and his girlfriend weren’t killed just on principal.

I hope to see the followup on this case. If he gets convicted, based on the current info, it will be a travesty.

It won't unless the guy is found not guilty. One jury I'd like to be on.

Not even considering penetration, the impact could do one in.

??? How so? Newton says the momentum of the bullet must be the same magnitude as the recoil of the firearm, so unless people are killed by 30-06 recoil, the impact without penetration would not kill anyone. Bullets kill by putting holes in things that shouldn't have holes in them

We have laws that all police and other private contractors (but I repeat my self) always follow.

No-knock warrants mean no notice before entry. So the occupant has no way of knowing that the police are “calling.” In such a case, shooting is a perfectly reasonable reaction to a home invasion in progress. The cops have apparently learned nothing from ATF’s debacle in Waco - in their very own state of Texas - with the Branch Davidians.

Most body armor worn by SWAT teams is easily defeated by any rifle round. A 5.66mm penetrator will cut through it like a hot knife.

Not exactly. The recoil of the firearm is spread out over a much longer time than a bullet impact. Also, recoil has to move the mass of the weapon before it gets to the shooter and the buttplate of the weapon also distributes the force over a much larger area than a bullet impact. Trust me, plate or no you don’t want to be hit by a 150 fr bullet traveling at 2900 fps with 2,400 ft/lbs(more or less) of energy.

If what you are saying is true then if you fired a weapon hanging freely then the weapon would travel just as far as the bullet.

But, I get your point.....

For instance, do you know of a single case where this strategy has worked?

A few years ago, here in Pittsburgh, a young lady whose home was the subject of a “no knock” warrant shot and killed one of the deputies.

The case never went to trial. Apparently she was quite guilty of the drug charges, they had her dead to rights on that, and she agreed to 20 years. The initial charges of capital murder were never put before a jury.

Absolutely.

Do I think some should be more equal than others? Nope, but I’m talking about the real world, not your (or my) opinion of how the world ought to be.

For instance, when was the last time you heard of a court decision settled on the basis of an appeal to the 9th or 10th Amendments? They’re there in the text, but they have no effect in the real world.

The 2nd Amendment was largely ignored and misapplied for most of the last century, only lately being given some small part of the respect given the first Amendment.

3rd Amendment is a dead letter. Conditions have changed to the point where it just doesn’t apply.

7th Amendment is completely ignored, especially with regard to the $20 amount specified.
