Deputy killed as SWAT Team breaks through door to serve “No Knock” warrant

On December 19th, a sheriff’s deputy was shot and killed during an attempt to serve a “no knock” warrant near Sommerville, Texas. Just before 6:00 A.M. an 8 member SWAT team broke through the door of Henry Goedrich Magee to serve a warrant which would permit the team to search the mobile home in which Magee and his pregnant girlfriend were living. Reacting to the pre-dawn, forced entry Magee grabbed a rifle propped against a bedroom door frame and fired at the unidentified intruders, killing 31 year old sheriff’s deputy Adam Sowders. No one else was injured and Magee was taken into custody. He is being held on $1 million bail and has been charged with capital murder, punishable in Texas by life in prison without possibility of parole or death by lethal injection.

These are the broad facts of the case as first reported by a number of print, radio and TV sources. The following additional information has been made public during the past few days:

I can't get to the need for a "no-knock" warrant. I had assumed those were reserved for those being an immediate threat to public safety by their intent to use violence: all of which having to be demonstrated by a defined body of evidence.

I can't convict if these turn out to be the facts. I would, however, be predisposed to award the homeowner a sizeable amount in a civil suit against the county, for violating his constitutional rights under the color of law.

31 year old sheriff’s deputy Adam Sowders’ last thought was:
“I don’t deserve this—to die like this. I was-——————”

My thought “ poetic Justice for a Ignorant action by Adam Sowders”!
Waco had the same discipline by LEOs!

The authorities need to stop using SWAT teams to handle routine situations.

The police are no longer just police but gestapo like militarized mechanized storm troopers. I fear we are losing our freedom and the police seem to like being aggressive beyond their civic responsibility.

I reside in Texas and people really don’t care for the no knock nonsense that goes on and I bet a jury will not convict him.

Cops have forgotten that no-knock entry was intended only to prevent evidence from being destroyed.

If the amount of drugs can be quickly flushed down a toilet, then you're a pretty low-lovel offender.

There's two types of drug dealers; those who need forklifts and those who don't.

I did a quick search of my electronic version of the Constitution.

I did not locate the phrase “No Knock” in any of the main text or amendments.

I did find this thing called the Fourth Amendment, though . . .

True, but do you believe that citing the Fourth Amendment would keep you from being charged with capital murder?

Good luck with that.

I believe it should have that effect, but that it won’t.

Actually, I’d say that a young deputy was killed because of the stupidity of a corrupt judge and a corrupt deputy boss. Also likely a corrupt sheriff. He was just doing what he was told—although I suppose there’s a problem with that, too. But he may have just been told that this was a dangerous criminal.

I hope this incident dampens enthusiasm to use SWAT teams to serve routine warrants in the future. They could have just waited until the suspect left the house at any time and searched the home

They could have merely waited until 6 AM or so when it was light, thrown a rock against the door, and yelled "Police". He could have looked out the window and surrendered--or if he wanted to fight (which seems unlikely), he would have been at a terrible disadvantage.

The no-knock invasion only serves the ego of the arresting team in a situation like this.

You know things are very screwed up when home invaders yell "Police" to confuse and help overwhelm the residents. In this country, the residents should know (and used to know) that the policed don't behave like that.

My thought as well, It's not that hard to drop a plug into the sewer clean out that normally is located near the front of the house.

You can actually trace this tragedy back to the Legislature, who passed:
* laws supporting no knock warrants
* Castle doctrine laws, allowing use of lethal force against intruders

Evidently Legislatures only have the attention span to consider one law at a time, and ignore interactions.

[ No Knock Raids... Another legacy of the War on Drugs. I supported the WOD for years, but today I would say “No, the damage to the civil rights and liberties of the citizens of the United States far outweigh any benefits gained from the War on Drugs.”

And it must go into the ash-heap of history as a good idea gone wrong. ]

Isn’t it funny how the war on drugs used to take place on cartels who lived in distant lands and along our borders, but now has been turned exclusively inwards towards our citizens while our Borders lay prone to anyone who wants to walk across them...?

We can’t patrol our G_D D_mned borders anymore but we can setup no knock raids and shoot peoples dogs and raid the wrong addresses and shoot innocent citizens... But patrol the border, no that would be mean and not politically correct......
