Constitutionality of Renewable Energy Mandates in Question

With a potentially striking blow to renewable mandate advocates, a recent federal court ruling calls into question the constitutionality of key components of many states’ renewable energy mandates.

On Friday, June 7th U.S. Circuit Court of Appeals sided with the Federal Energy Regulatory Commission (FERC) against the state of Michigan (among other petitioners) in a dispute over FERC’s plan to apportion costs for new power lines to transport millions of megawatts of wind power around the Great Lakes region.

Puleeze.

The constitution is now irrelevant.

And will continue to be so until we tell the government to shove it up their collective smelly Obamas.

And back that up with resolve.

Fortunately we crushed the alternative energy mandate on the ballot in Michigan last year. Even its supporters admitted it was impossible but they wanted it anyway to stand in the way of actual energy production and as a means of seizing funds.

While I do consider myself a realist, I am not a fatalist. The constitution is still very worth fighting for and decisions like these ones makes me think there is at least a glimmer of hope.

Exactly. I saw the result of that ballot initiative. Decisions such as this one and when the people vote against crazy ballot measures make me think that there is at least a glimmer of hope.

I read that we would have to erect some 4000 windmills to achieve what the level demanded for a 25% renewable mandate.
