Police State Raids Family’s Home: “The Fight Has Officially Been Brought To My Front Door”

When certified firearms instructor Shawn Moore posted a photo of his 11 year-old son on Facebook the last thing he expected was a SWAT style raid on his home. The picture showed his son, a licensed hunter, holding his new birthday gift, a .22 caliber rifle.

While Moore’s son proudly displaying his semi-automatic personal defense rifle was completely legal, an anonymous tipster contacted New Jersey’s Department of Children and Family Services and declared that the Moore family was neglecting and abusing their child, an unfounded accusation that led to the mobilization of local police who were apparently not at all concerned with the unconstitutionality of their actions which violated numerous protections of the Moore family including their right to bear arms, their right to be secure in their homes, their right to speak freely, and their right to be considered innocent until proven guilty.

Of critical importance is that the police who raided the Moore home never even saw the photo.

“It was all hear say. Just a phone call saying someone saw a pic of a child holding a gun,” reports Moore.

Shawn Moore recounted the incident at the Delaware Open Carry forums:

The fight has officially been brought to my front door.

Last night I was out with a buddy of mine. I got a text from my wife that the cops and DYFS [Division of Youth and Family Services] are at the house and they wanna check out my guns and needed me to open my safe.

I’m instantly on my way. I get in contact with [attorney] Evan Nappen on the way. I explain the situation.

I walk in my house and hand the phone to the first cop I see. Then direct all of them outside. DYFS got a call because of a pic of my son holding a gun.

They wanted to look around and check all my guns out, make sure they were all registered.

Obviously that didn’t go well because I refused.

I had Nappen on speaker phone the entire time so they had to deal with both of us. They kept trying to pressure me to open my safe. They had no warrant, no charges, nothing.

I didn’t budge.

I was told I was being “unreasonable” and that I was acting suspicious because I wouldn’t open my safe. Told me they were gonna get a search warrant. Told em go ahead.

Nappen (my lawyer) asked me for the DYFS workers name. She wouldn’t give it. I asked for credentials and she wouldn’t show them. I tried to take a pic of her and she turned around real fast and walked away.

After a while of them threatening to take my kids, get warrants and intimidation they left. Empty handed and seeing nothing.

People it can happen that fast.

So you’re saying that children have no rights but that which an adult chooses for them.

In a rational society - one stable enough to continue - rights (authority) and responsibility are balanced. Since a child has no legal authority to do things like enter contracts and has no legal duty to do things like participate in juries, then with respect to social rights, they don't necessarily have any.

This is predicated on the definition of 'right' as a capability which the state has the power to take away from you, but not the authority to take away from you. Hence, there is a valid 'right' to keep and bear arms. You don't have a 'right' to pursue happiness because that is a tropism - even in the most vile prison on earth you can pursue happiness. If you're going to say that even a child has a 'right' to life, then you need to explain how that applies to a child that is at sea too far from land to swim. The same applies to the 'right' to self defense. If you face an adversary who is stronger (or better armed) and intent on violence, you have only the right to try to defend yourself. And the state has the power to penalize you for exercising that right, but not the authority to do so.

So, does a child have a "right" to self-defense? I know that if I were on a jury and a child acted in legitimate self defense, I would not convict him of any crime. But if he acted wrongly, claiming self defense but in a way that an adult would not find compelling, then I'd go after his parents, not him.

In Texas, the identity of a person going to/or calling, social services is not allowed to be identified.

An almost related friend in Dallas takes care of her mother who is senile. If the daughter gives the mom her social security check, she walks to a drug store when the daughter is not home and puts enough aspirin products in her cart to require the whole check for payment. As a result, the daughter, who is a responsible person, gives her mom money but not the whole check at a time. The mom, again being senile, calls 911 and says her daughter has her in prison and won't give her the SS money, or she goes to a neighbor to have them call social service.

The daughter has been grilled over and over by cops and social service every single time this happens. There is always someone who believes the mom and calls social service. The only one who gets in “trouble” is the daughter.

The senile lady is the sister of my ex-mother-in-law and she is almost 90 herself and has problems thinking correctly, so the senile one calls her to have her call Dallas social service, which she does, time after time, and the daughter is in trouble again.

I don't know what I would do if the senile one was my mother calling the cops and social service every time she got it in her head I was keeping her in prison and keeping her money away from her. In this case, I would be sorely temped to put the mom in a nursing home which would stop the harassment of me.

I know there are terrible things that are reported to social services and the caller could be even killed if the bad person knew who called, but this is terrible the daughter has to go through this time after time.

My friend went thru that with his mentally failing father and his gold digging Alcoholic girlfriend. He ended up having to petition the court for legal guardianship. His father’s girlfriend tried to fight it.

It was stressful for the Son and his Father’s friends who saw it play out. But in the end the Judge granted him guardianship and his father’s gold digger was sent packing.
Dad was put in a 24 hour care center (By then he didn’t even recognize his Son) and she was given an eviction notice.

Hate to disagree, but they’ll go back further than that.

They’ll go back to the 17th amendment, probably the 19th, Roe v. Wade and the ‘penumbras and emanations’. They’ll go back to causis belli of the Civil War, and the idea that the feds could tell the states what to do about slavery.

When the feds told the states whether they could or could not have slavery, it jumped the 9th and 10th amendments, and the slope has been slippery from there.

Unfortunately I have not had to think of a “Plan C” as yet...If I need that, we be in heap big time trouble kemosabe...

When Julius Caesar crossed the Rubicon river, historians consider this the defining moment when the roman empire to have begun and the republic to have died. Even people living at the time knew that this was the case.

Very few people living at this time would consider that the US republic died when the 17th amendment was passed. Some folks think it happened with the civil war, but it is a small minority and certainly not ‘most historians’.

I needed an attorney to help me with some documents (she's a Republican and tough as nails) and I have her card in my purse along with other cards but I didn't put hers there to have it in case I was in trouble. That stack of cards is one from my doctor, one for Prissy’s vet, one for her groomer, my hair dresser, etc., just cards to find numbers fast.

Now that this gun situation has happened, I'm glad her card is in my purse. But, since this happened, I'm going to put her number in my cell phone so I can just punch it and it calls her.

The documents I needed help with and getting them recorded at the courthouse, was after my husband's death, and she wouldn't take any money for helping me and took them to get them recorded herself so I didn't have to go there and do that. I know we dump on lawyers all the time, but she is exceptional.

You know I have several defense weapons now but would we have thought five or six years ago that we could be in jeopardy having them and having magazines that hold over ten cartridges? As we are threatened bit by bit, we adjust to one bit, then another bit happens and we adjust to that one. At what point are there enough butterfly wings that flapped that critical mass is reached and an explosion happens? Where do we draw the red line (as Netanyahu did)?

MrB, while certainly what you stated should be our bare minimum response, I think you will have to agree that passive resistance has not worked in NY as for all practicable purposes the 2nd Amendment is null and void.

SHALL NOT BE INFRINGED is an absolute yet we allowed the communists on the left to distort the 2nd Amendment by focusing the debate on the Militia portion when in fact, and simple understanding of English would tell any honest person that the RTKBA SHALL NOT BE INFRINGED cannot be modified by the first part of the phrase.

In our airports, train stations, government buildings our 4th Amendment rights are null and void.

In our communications again the 4th Amendment is null and void.

As the scum of the earth Islam takes hold in the USA our 1st Amendment rights will be null and void as nothing can be said against Is_slime regardless of how true it may be.

As proved by Holder refusing to prosecute the NAPAs in Philly who were intimidating votes our right to free and honest elections are null and void.

A simple reading of the Communist Manifesto will reveal exactly what our ruling elite are doing and we are no longer in control of our government. It was never intended to get to this point hence the Thomas Jefferson moment.

This country has been lost from the roots on up. The public school system has destroyed the roots for decades such that the vast majority of citizens know more about American Idol than the very foundation of the country.

If we have not reached the appropriate line in the sand, just what else do the ruling elite have to do to use before that line is crossed? I submit the line was crossed years ago and we did not have the backbone to fight the communists.

By your own standard, the time between Julius Caesar and the fall of the empire was 500 years or more. Rome even had a golden age after Claudius.

They’ll probably look at the Civil War as the moment, not the Barack Obama BC thing. That’s when we decided to gut the 9th and 10th, which was the point of the founding document in the first place.

It would probably be more appropriate to say that when the US went from gold to fiat currency, that was the beginning of the end. No fiat currency has ever survived, and we knew that at the time and did it anyway.

It’s an interesting question.

Facebook is privacy invasion on steroids, people think they are safe but they aren’t. Anything put on the net is out there for everyone with the know how to hack into at anytime. Seems like people think Hillary or the Bushes are the only people who can be hacked.

And I don't mean go levy some gadfly lawsuit amounting to ten or twenty thousands dollars; I man go for the throat, and make every credible attempt humanly possible to PERMANENTLY, TOTALLY BANKRUPT every last MF'n bastard involved.

Take their homes. Take their cars. Take their pension funds. Take their stocks & bonds. Take their gold. Take their land. Take their furniture. Take their appliances. Take their computers. Take every last thing of any value whatsoever. Take very clothes off of their quisling backs, and leave them with everything they wanted to leave you with: NOTHING but the ringing in their ears of their empty-handed, wailing wives and children.

THESE PEOPLE MUST BE BROUGHT TO UTTER RUIN!! PUBLICLY!!

It MUST happen, or these sorts of things will never cease.

I will second that one. Had a disgruntled neighbor call me in as a professional drug dealer. On my day off 2 hours after I finished cleaning my AK47 a dozen hopped up speed junkies and dogs smashed my front door in, went through everything in my computer, took 2 antiques and relieved 400+ bucks from my wallet, claiming there was 16 dollars in it.
I always suspected who made the anonymous call and put a half ounce of seeds and stems in my trash, but 8 years later I really don’t know. Sometimes the accusation is so important it deserves investigation regardless of merit...
