COMBAT VETERAN ARRESTED! [accused of possessing high-capacity magazines for an assault rifle]

Nathan Haddad, a decorated combat veteran with multiples deployments to Afghanistan, who has spent spent 12 years serving his Country in the United States Army, is now under Arrest!

Every gun manufacturer and ammo maker should cease sells in New York. And that includes to law enforcement agencies. Simply issue a statement that they want to make sure good people don’t get arrested so they won’t be selling their products in the state. Loot at the tax revenue they’d lose. Plus, it would probably make a lot of cops join in the protests.

The tobacco companies should have done the same thing.

I knew I should have made an exception for fellow FReepers!

I’ve been to NY state four or five times over the years, and for some reason always get the stink eye from the natives. Maybe they don’t like flannel? ;)

But I do have Personal Defense Rifle(s)...

Which you cannot tell me to register or relinquish...

Second: why did he allow the cops to search his car?

It's not clear that he 'allowed' them to do so. But if he did it could have been because he didn't think he was doing anything illegal and "had nothing to hide". But that is speculation, his lawyer has told him to keep his mouth shut, for now.

Third: if the gun ban hasn’t taken effect yet, why is he under arrest?,

He's under arrest for violating the previous law, which banned 10+ round magazines.

BTW, does anyone know if US military issue M16/M4 magazines are so stamped? Even if they are, it doesn't mean that possessing them or even selling them is illegal in and of itself, unless of course they weren't really surplus, but were stolen.

Checking around. . .it looks like the Restricted markings are from the now defunct Clinton era "assault weapons ban" (1994-2004). I've seen the restricted marking on some EOTech holographic sights too for some reason.

From some chat in a forum:


I've seen several items on auction that have RESTRICTED MILITARY/GOVERNMENT LAW ENFORCEMENT/EXPORT USE ONLY stamped on them. How does this apply to a civilian should they buy it?

I have those markings on all my pistol mags and it only means they weren't civilian legal during the Clinton AWB. (9-1994 to 9-2004)

Only in states that still have a ban... Otherwise, the markings have no bearing on anything.

Emily Miller of the Washington Times writes a good informative article. That does clear up some of the questions. I’m glad to see this getting some media attention which I think will help put pressure on the authorities to reduce the charges.

Reminds me of a couple of incidents of tourists that were caught with their carry guns in New York City. It caused a lot of publicity, and I remember hearing that their charges were reduced eventually. And of course, people with favored status get a free ride all the time on charges like this.

Cheaper Than Dirt has Colt 30-round AR15 magazines selling for $100 a piece. The suspects will at least be able to cover some of their legal expenses.

from Washington Times - some info about the police search, as to... Why?


On Jan. 6, the Jefferson County police coincidentally turned up at the same place and time as a meeting where Sgt. Haddad, now a civilian employee at Fort Drum, was to sell the empty AR-15 type rifle magazines. He did not have the rifle with him, so there was no threat of violence.

The soldier was asked what he was doing. Believing he was not committing a crime, Sgt. Haddad told the police officer what he was selling. The police looked at the bottom of the magazines to see if date stamp, and then arrested Sgt. Haddad because the items were made after 1994. (Earlier this month, Gov. Andrew Cuomo changed the Empire State again so that magazines will be limited to seven rounds maximum.)
