The girlfriend sounds like a real dim bulb. She says he wasn’t aggressive but she wasn’t there. Then she says she doesn’t want to judge but that she wants justice.

The driver’s window glass will tell. If it was broken by blunt force from outside, she wins; if it was broken by a bullet on the way out, she just gunned him down.
Tactically he made a mistake that policemen are careful to avoid. When approaching a car to talk to a driver, you always stop about 15 degrees behind their left shoulder, so you are a much harder target for them to shoot than if you are right by their window.

[She] got involved in road rage with an individual who wrecked her car, followed her into a gas station and jumped out of his car and began attacking her car, she said. The road rage occurred on the road, I take it, and not "in the parking lot".
It's a he said/she said/he's dead situation until we hear from the deceased's passenger and sort the information out.
She says he hit her car. Who failed to yield right of way in traffic? Did he or she speed up and hit a horn instead of yielding to the other car (when pulling out of a driveway/yield/lane change)?
He "followed" her to a gas station. I wouldn't call that stalking. If he "hit" her car, he'd have to exchange information or else be cited with hit and run.

Alleging that Ables broke the drivers side window of Scotts car, Quiñones cited this as evidence of the ferocity of the attack. In the ABC 13 account, I thought she fired through the window. Which was it? He broke it or she did? Or did he break it and then she shot through the open frame?

True enough but in West Virginia this sort of thing would get a ‘decline to prosecute’ action by most county DA’s unless the dead fellow was the son of a judge or some other worthy.

An eyewitness, who appeared on camera but has requested anonymity, said that he did not hear any threat in the seconds before Scott killed Ables. The witness was pumping gas and standing 15 feet away from Ables when a bullet ricocheted past him and struck his car. The bullet left a noticeable impression on the witnesss car. It's dangerous to be pumping gas and have bullets whizzing past you. Even Michelle has said it is dangerous for Barack to pump gas. Apparently even civilians in Houston have to watch out.
