Sooo....

Obama will be FORCED to veto the repeal effort. Gee...the GOP sure has him over a barrel, eh? I’m sure he’ll be simply devastated to be forced to use his veto powers (sarc).

Sorry, but.. somebody is delusional here. I really don’t see an upside to this. Maybe it’s these damned glasses (not rosy enough).

No need to repeal it. Obama has set the precedent for how to neuter it - just make it a matter of policy to not enforce it. DOMA, Immigration, Voter rights act, he’s done it successfully several times.

So, an insurance company doesn’t want to cover you because of a preexisting condition? Yeah well, we’re not enforcing that today....

Don’t pay the tax. Illegal? Sure, if we were enforcing that...

IANAL, so I'll ask the lawyers - isn't this thing about the Senate not allowing filibusters on tax bills simply a Senate rule? It's not enshrined in the Constitution or anything (not that that seems to count for much these days) - why couldn't the current Democrat-controlled Senate simply change the rule?

And even if it's not practical for the Democrats to do this, this avoidance of a filibuster still requires a Republican majority in the Senate, and a Republican president. These might be attainable. But it also requires a Republican president and senators with some semblance of conservative principles, and that might not be attainable.

I've seen this proposed: since the SC has ruled the mandate to be a tax, and since the ACA bill originated in the Senate, and since taxes must be proposed in the House, maybe someone will bring another lawsuit that Roberts won't be able to find a way to evade.

It must be stated at every opportunity that we only need a simple majority in the Senate and House plus the presidency to REPEAL this regressive massive taxation. Many Conservative minded people are probably thinking there is no hope because of filibuster....

Wouldn’t this require some democraps in the senate to go along with it?

Not that it isn’t possible- I think there may be one or two sensible dems shaking in fear at what this decision means to the next election (that can’t ALL be stupid, can they?)

yuesterday, this entire office (where I work) was suddenly **very** quiet after the decision was announced.

People avoid discussing politics here (there are some hard-core libs, everyone here thinks they are dumbasses) but the temperature of the room changed dramatically yesterday- I have never heard it suddenly go so quiet

(and NOT in a good way)

No filibuster is a great thing.

But they totally miss the point on the commerce clause. What they did was open the door wider. Previously, the left needed to squeeze things through the tiny crack that was the commerce clause. What Roberts did was to blow open all the doors and windows and now the simple power to tax is unlimited.

So because the individual mandate is now classified as a tax, it can be repealed next January if the GOP wins the White House and wins or ties in the Senate. The Dem Senators can’t filibuster the repeal because we can use the exact same “budget reconciliation” tactic against them that they used against us in 2010 to pass this monstrosity. I love it!!!

Also, even though it's obvious that Obama would veto it, I think there's at least a chance we can get it through the Senate right now, forcing Obama to look bad by vetoing it.

Remember, it was 6 years ago that the Dems flipped the Senate, meaning that this year there are a lot of freshmen Dem senators from Red or at least Purple states, facing tough re-election battles.

Dem Senators up for re-election must now be asking themselves: "This close to the election, do I want to go on record as being THE vote that killed the Mandate-Repeal? Or can I just say Hey, it's a moot point how I vote, since 0bama's sure to veto it anyway. So either I vote to repeal the Mandate, which makes bambi look bad but helps my re-election chances. Or I fall on my sword by voting it down and then losing my seat all so bambi doesn't lose face. Gee, what should I do? What a tough decision!"

What's unclear to me is: Does Dingy Harry have the means to prevent a Senate vote? And if the answer is Yes, would those means require "creative re-interpretation" of some old rule in order to use it in ways never intended, thus setting a precedent that hands a new weapon to future GOP majorities as well?

No, no, NO!

Do not vote to repeal it now. That will only provide cover for vulnerable Democrats for this election. They will vote for repeal hoping that voters believe they are actually for repeal, while they know that it will stand because Obama will never sign the repeal.

Vote for repeal when we have the Senate (only need 50 now) and President Repulican. This is very doable now if we get to work!

Anyone who thinks ZeroCare is going to be repealed - before or after November - is living in a dreamworld. The PTB have already telegraphed this by placing the author of ZeroCare-Lite on the top of the republican ticket. They no longer feel it is necessary to hide what is going on, so you can also expect a republican VP candidate who, similar to Obama, is not eligible to be POTUS.

As long as you keep playing their game, you will play by their rules.

If Zerocare is repealed, I will send an extra $100 to FR after the bill is signed. That's some really safe money folks.
