Yesterday was full of stunning decisions:
First, of course, the Supreme Court delivered their decision on Obamacare() and the Commerce Clause () more on that later...
...Its probably because I was so distracted by all the blowback from the Supreme Court decision and wasnt paying close enough attention.
Fortunately, Clarice American Thinker author, D.C. attorney and resident MOL - was all over the case. Heres her final analysis; its an OUTSTANDING review of why yesterdays Supreme Court Decision isnt as bad as you might think. DO NOT and I mean NOT miss Clarices Pieces today on American Thinker (I know its not Sunday yet, butt this is BIG): Obamacare: Things Are Now Up For Grabs.
It will help put things in perspective, make you feel better and load you up for the long game. As Mary first mentioned yesterday, Clarice elaborates on how the barn door on the Commerce Clause has finally been closed (after we lost most of our ponies, butt still ) and points out few things that you may not have thought about yet, including, butt not limited to this:
The ball is now in the Republicans' court. They've already scheduled a repeal vote on July 11. Once before the Democrat-controlled Senate was able to scotch the effort by threat of filibuster. Had the mandate stood as mandate they could do so again. But now that it's a tax, it can be passed by a simple majority. And if it is, the president will be forced before the election to veto a repeal of a law a majority of the voters keep indicating they want repealed.

Remember, it was 6 years ago that the Dems flipped the Senate, meaning that this year there are a lot of freshmen Dem senators from Red or at least Purple states, facing tough re-election battles.
Dem Senators up for re-election must now be asking themselves: "This close to the election, do I want to go on record as being THE vote that killed the Mandate-Repeal? Or can I just say Hey, it's a moot point how I vote, since 0bama's sure to veto it anyway. So either I vote to repeal the Mandate, which makes bambi look bad but helps my re-election chances. Or I fall on my sword by voting it down and then losing my seat all so bambi doesn't lose face. Gee, what should I do? What a tough decision!"
What's unclear to me is: Does Dingy Harry have the means to prevent a Senate vote? And if the answer is Yes, would those means require "creative re-interpretation" of some old rule in order to use it in ways never intended, thus setting a precedent that hands a new weapon to future GOP majorities as well?
No, no, NO!
Do not vote to repeal it now. That will only provide cover for vulnerable Democrats for this election. They will vote for repeal hoping that voters believe they are actually for repeal, while they know that it will stand because Obama will never sign the repeal.
Vote for repeal when we have the Senate (only need 50 now) and President Repulican. This is very doable now if we get to work!
The problem is with the Byrd Rule. If any Senator objects based on it’s provisions and the Presiding Officer (which is always of the Majority Caucus) upholds it still takes a supermajority to override. So nothing is going to happen in the Senate unless/until the GOP takes control of the chamber.
The truth of the matter is we were royally fucked in the basest of manner. The final results will not be known for another 10 years down the road.
Right. That has always been the case. But if zerocare was presented as a TAX would it have passed? No. If buying GM cars was presented as a tax, would it pass? No. That’s the tarnished silver lining. Any outlandish tax in the future will have to be presented as such, and if we elect people who would pass those kinds of taxes, then it’s our fault.
Roberts was right in that we get the government we elect. It has always been the case that if we elect scum, we get scum legislation.
What the USSC did was legislate from the bench and it’s clearly unconstitutional. Roberts stinks. I’m just trying to focus on anything that might not be a total piece of cr@p in the decision because otherwise I would go crazy :(
Interesting opinion, but worthless if we don’t have 51 votes.
“.......Vote for repeal when we have the Senate (only need 50 now) and President Republican. This is very doable now if we get to work!”

There will be MANY things we can do starting in 2013. However, I’m convinced they will be accomplished ONLY if we have a sufficient number of TRUE CONSERVATIVE Senators willing to replace McConnell with someone with actual guts and a will to carry forward with necessary action.
As long as you keep playing their game, you will play by their rules.
If Zerocare is repealed, I will send an extra $100 to FR after the bill is signed. That's some really safe money folks.
Many have no hope McConnel will even try to get this through the Senate.
