ObamaTax Repeal Is Filibuster Proof!

Yesterday was full of stunning decisions:

First, of course, the Supreme Court delivered their decision on Obamacare() and the Commerce Clause () – more on that later...

...It’s probably because I was so distracted by all the blowback from the Supreme Court decision and wasn’t paying close enough attention.

Fortunately, Clarice – American Thinker author, D.C. attorney and resident MOL - was all over the case. Here’s her final analysis; it’s an OUTSTANDING review of why yesterday’s Supreme Court Decision isn’t as bad as you might think. DO NOT and I mean NOT miss Clarice’s Pieces today on American Thinker (I know it’s not Sunday yet, butt this is BIG): Obamacare: ‘Things Are Now Up For Grabs.’

It will help put things in perspective, make you feel better and load you up for the long game. As Mary first mentioned yesterday, Clarice elaborates on how the barn door on the Commerce Clause has finally been closed (after we lost most of our ponies, butt still…) and points out few things that you may not have thought about yet, including, butt not limited to this:

The ball is now in the Republicans' court. They've already scheduled a repeal vote on July 11. Once before the Democrat-controlled Senate was able to scotch the effort by threat of filibuster. Had the mandate stood as mandate they could do so again. But now that it's a tax, it can be passed by a simple majority. And if it is, the president will be forced before the election to veto a repeal of a law a majority of the voters keep indicating they want repealed.

Ok, then give us you plan other than to toss crap at this.

Because there are people that are doing whatever we can to turn this back, and if some of the people on FR today dont have anything constructive to add then do us a favor and dont say anything. For every effort or idea put out here there are 4 sad excuses that will try to tell us how “useless” it is.

The ObamaTax Individual Mandate needs only 51 votes in Senate AND can NOT be filibustered because the fools rammed it through under "budget reconciliation"!

Reid wouldn't let this pig come to the Senate floor in a million years. Not that he needs a million years... 4 months will do.

There hasn’t been an upside! From the getgo, congress(all of them) failed to uphold their oath to defend the constitution! They could have stopped him from becoming president! They swept all his foreign dirty secrets and lies under the rug! The avg American didn’t have a clue( and still doesn’t) as to what this Manchurian Candidate is up to! And now we are here, with illegal laws that restrict freedom and destroy business! Soon it will be complete slavery! Upside? I can think of one: The Lord is my rock! The rest? It’s all a sham!

Its worse than that. All the moping and defeatism is a delicacy for DUmmies looking in. FReepers are feeding them a great feast and the DUmmies are getting maximum enjoyment from it, just as we would by looking in on them had dumbocare been thrown out.

A bambi veto of a repeal of a huge tax won’t look good right before the election.

Who thinks a repeal of the Obamacare tax could pass the Senate before the election, even with 51 votes? The Dims still control the Senate. Are there Dim Senators vowing to vote for a repeal?

Exactly: There is no way to sugar coat this. Accept it we are NO LONGER A FREE PEOPLE. This is Totalitarian government. Taxing you for not buying health care insurance is just first on the list. And don't forget, THE DOCTORS ARE QUITING, THE DRUG COMPANIES ARE QUITING, so I'm not sure what people think they are going to get when the government takes their money. They are just going to get sick and die broke, just the way the Marxists like.

I seriously don't think it's sunk in just what has happened to our country. A huge majority of the people did not want any part of this yet it's here and we have been voting. One man, John Roberts was the last lifeline to our freedom and he sided with the Marxists. I wonder what he is getting in return? When you read the dissent it's very clear that Roberts had to be coerced into changing his vote or he has been a closet left wing idealogue the whole time and we never knew it until now.

Either way, we are still not free and we are hoping to vote ourselves free in November. That's not a very good prognosis.

No, we don’t even have a simple majority....yet. So actually, bambi won’t even have to veto. However, the sarcasm that I commented on considered a veto scenario.

Wouldn’t this require some democraps in the senate to go along with it?

Not that it isn’t possible- I think there may be one or two sensible dems shaking in fear at what this decision means to the next election (that can’t ALL be stupid, can they?)

yuesterday, this entire office (where I work) was suddenly **very** quiet after the decision was announced.

People avoid discussing politics here (there are some hard-core libs, everyone here thinks they are dumbasses) but the temperature of the room changed dramatically yesterday- I have never heard it suddenly go so quiet

(and NOT in a good way)

You need a Republican President, House and Senate to do it.

A one seat advantage in both the House and Senate will accomplish the goal.

You won't need 60 Senate seats to avoid a Filibuster and you certainly won't need a Two Thirds House and Senate Majority to avoid a Veto from a Republican President.

So let's do it. If Obama is reelected, Obamacare lives.

The tarnished silver lining in all of this that congress can NO LONGER pass legislation like buy a GM car or eat FDA diet etc. pushing it through under the commerce clause. It will have to be PRESENTED as a tax. Under that pretext, buying a GM car or eating an FDA diet or even Obamacare would NEVER get through congress as a tax. The libs rolled the dice and won. But they can’t roll them the same way next time. However, they’ll think of a slimy new way to spike the game.

No filibuster is a great thing.

But they totally miss the point on the commerce clause. What they did was open the door wider. Previously, the left needed to squeeze things through the tiny crack that was the commerce clause. What Roberts did was to blow open all the doors and windows and now the simple power to tax is unlimited.

I think you miss the point. We lost big time. It only takes 51 votes to pass a tax. It takes 60 votes to pass it via the commerce clause due to filibuster rules.

So because the individual mandate is now classified as a tax, it can be repealed next January if the GOP wins the White House and wins or ties in the Senate. The Dem Senators can’t filibuster the repeal because we can use the exact same “budget reconciliation” tactic against them that they used against us in 2010 to pass this monstrosity. I love it!!!
