Stand With Arizona
Rep. Steve King (R-IA) announced in a radio interview that he is planning to file suit to block Obama from bypassing Congress to implement his amnesty plan for 1 million (and possibly far more) illegal aliens.
King, the vice-chairman of the House Judiciary Committees Subcommittee on Immigration Policy and Enforcement, and a good friend of SWA, has been a stalwart opponent of illegal immigration and amnesty. King last year introduced the "Birthright Citizenship Act" (H.R. 140) which would adjust Federal immigration and naturalization guidelines to prevent the "anchor babies" of illegal aliens from obtaining American citizenship.
Today, on the Mike Huckabee Show, King said he would sue to stop the new Obama amnesty plan, and that he successfully sued his own states governor and won over a similar separation-of-powers issue.
I will tell you that Im not without experience on this Im prepared to bring a suit and seek a court order to stop implementation of this policy, King said I have done it once in the past successfully when then-Governor Tom Vilsack thought he could legislate by executive order and the case of King vs. Vilsack is in the books.Huckabee followed up, asking King: You plan to sue this administration for implementing something that you believe should have required legislative process and approval? That is correct, King replied
Obama's order grants virtual amnesty to all illegal aliens who were "under the age of 16" when "brought here" illegally; who have resided here for 5 years; and who attended college or serve in the military. The media is parroting Administration talking point that this would affect "at most 800,000" individuals, but House GOP data shows this deals with well over 1 million illegal aliens.
And as we earlier noted, this figure is irrelevant if the criteria of the twice-defeated DREAM Act - which Obama has adapted - would permit new border crossers, those who came here from 17-35 years old, and those presenting phony documents, to apply for amnesty under this order, and would be granted an immediate stay of deportation. This stay could then be extended indefinitely by the DHS Secretary at her own discretion and NOT subject to Congressional approval.
As a result of these ridiculous lax rules, we will likely see an immediate rush to cross the border in order to obtain fraudulent "documents" and get in on the new Obama amnesty.
Indeed, one look at the DREAM Act Facebook page shows you they are already looking across the border...
Cynthia Vela Huete : Does anyone know if this will apply or benefit the ones that have been banned and have been in Mexico since banned in Cuidad Juarez??? ThanksWe also salute Rep. King for calling out Marco Rubio for his "DREAM Nightmare" alternative plan which has exposed Rubio as a rather naive and useful tool for Obama in his pimping of this shameless amnesty.
H/T to DailyCaller for the entire King-Huckabee exchange (Audio link here).
Takes you days to file it.
Takes a liberal activist judge 30 seconds to throw it out.
Have a nice day. :)
NO STANDING. I can hear it now.
At least he has the spine to say something which is more than others have done.
Nah. We know how to judge shop too, like the libs do every day.
1 million my ass! Where do they get that figure?
We have the children of illegal immigrants bursting our schools at the seams across this nation? It’s more like a number between five and ten million, and they damn well know it.
Nobody asked me if I want this nation turned into Mexico, or a Central American, or a combination nation?
End their ability to work here. We have plenty of unemployed citizens. Remove the children of illegal aliens from our schools, send them home. They take infrastructure and resources from the children of citizens. End the free medical care. They can get that in Mexico, if any government wants to be humane, that’s the one. All the other goods and services, they can get them in their home nation.
We have no obligation to these people whatsoever. This s—t has to end now!
RIP US.
Well, now we have one Republican who has spoken out against Obama’s dictatorial behavior. Have there been any others?

On hold now, and I will ask permission to record my call.
I got through!
I was very polite, and asked for permission to record my call...I was put on the line with a supervisor, who asked why, and told them for personal reasons. I was denied, then the female supervisor on the line refused to identify themselves even by first name, and I made my polite comment. At this point the telephone connection was disconnected followed by a dial tone.
... in addition to using America’s emergency rooms as primary care facilities...
A Congressman doesn't have standing to sue on behalf of Congress? That would be rich.
Obama just gave Amnesty to illegals. What Obama just did is illegal and an impeachable offense. Ok democrats and Obama tried to pass the Dream Act Amnesty .Republicans blocked it. So Obama passes the Dream act anyway by decree. wtf? Impeach this creature now.
I remember how many of us here fought the Dream ACT every time they tried to pass it. Now Obama basically passes the Dream act by decree. This is crushing. This Dream act is Amnesty and Obama just unlawfully gave Amnesty to illegals. We and the Republicans in Congress defeated this Dream act several times. All for nothing. what is this country coming to? I hate Obmaa.
What hasn’t this Obama done to destroy America, added 5 trilion in debt on us, gave Amnesty to illegals(bypassing of Congress), sent our jobs to China, exploded government size and power, used EPA to destroy what’s left of American industry, gave away our U.S. sovereignty to the UN and China etc.
Obama bases his executive order on his prosecutorial discretion. But even if he had the discretion to refuse to prosecute illegals, which he does not, he is going way beyond a mere failure to prosecute. He is ordering a change in their legal status to make them eligible to stay here and work. There is no authority in the law for him to do that and this has nothing to do with prosecutorial discretion. This is far worse than Clinton committing perjury while President. The Republicans in the House need to immediately pass a bill defunding any implementation of this Executive Order, even though the Dems in the Senate will not agree with it. This is crunch time for America and the Constitution. If he were not up for re-election in November, impeachment proceedings should begin.
Nice move Obama!...The shits going to hit the fan now!...With all the young Americans that can’t find jobs and you make it all the harder with amnesty for illegals who will be looking for jobs also? Good luck in the election, Gilligan!
Why not get real junk yard dog mean and file impeachment articles instead of a lawsuit.
Those illegal children have illegal parents, so you can triple the numbers at least.
Ready, in 5,4,3,2...
You think this will really happen? That a judge will actually grant a hearing and issue a restraining order?
I think we are all dreaming if we think this will be stopped.
This will all go the same way that eligibility has.
Other than King and maybe a handful of republicans I expect to hear crickets from the legislature on this latest impeachable act.
Same place they got the 10-12 million illegals. They pulled it out of a hat. You're in CA and I'm in AZ. Between the two states I'll bet there are more than 1 million. And since when does being 30 years old qualify you as a child that has lived here for 5 years or more?
As I understand this he’s going to ignore the law not deport them. That doesn’t mean he’s granting citizenship, does it?
Yes, but conservatives can play the pick the right judge game. If it works for the ACLU, it can works for conservatives too.
