Dear Mr. Jablonski:I received your letter expressing your concerns with the manner in which the Office of StateAdministrative Hearings ("OSAH") has handled the candidate challenges involving your client andadvising me that you and your client will "suspend" participation in the administrative proceeding. WhileI regret that you do not feel that the proceedings are appropriate, my referral of this matter to anadministrative law judge at OSAH was in keeping with Georgia law, and specifically O.C.G.A. § 21-2-5.As you are aware, OSAH Rule 616-1-2-.17 cited in your letter only applies to parties to a hearing. As thereferring agency, the Secretary of State's Office is not a party to the candidate challenge hearingsscheduled for tomorrow. To the extent a request to withdraw the case referral is procedurally available, Ido not believe such a request would be judicious given the hearing is set for tomorrow morning.In following the procedures set forth in the Georgia Election Code, I expect the administrative law judgeto report his findings to me after his full consideration of the evidence and law. Upon receipt of thereport, I will fully and fairly review the entire record and initial decision of the administrative law judge.Anything you and your client place in the record in response to the challenge will be beneficial to myreview of the initial decision; however, if you and your client choose to suspend your participation in theOSAH proceedings, please understand that you do so at your own peril.I certainly appreciate you contacting me about your concerns, and thank you for your attention to thismatter.Sincerely,Brian P. Obama will have to wait for the decision of the GA Secretary of State and then petition the Superior Court to reverse the SoS’s decision prior to going to the U.S. District Court.
If GA allows cameras in the court, it could get real interesting because it would be broadcasr far and wide. Even the liberal media outlets couldn’t avoid giving it gavel-to-gavel coverage.

Sadly (speaking as an atty) this is utterly meaningless as its an ALJ (from what I gather). Even if this were a State Trial Court it means nothing. If anything is to come of this, it would need to be through Fed Dist Ct.

If the GA SOS leaves Obama off the ballot there’s nothing to “stay”. Obama is the one who needs something to change, so stalling will do him no good.
Nobody was prepared beforehand for this issue in '08. By the time appropriate action was taken it was too late to correct the problem.
Now that people are aware of the issue, what should be a simple matter for any presidential candidate to resolve has become a running joke about one particular presidential candidate.

Thats my favorite part. Barry must have forgotten that GA is a totally Republican dominated state from Gov to both state houses. There will not be any bulldozing going on by his lawyers here. I hope they lack the intelligence to show up at that hearing tomorrow.
And if Obama’s lawyers let Savannah Guthrie feel the seal on a genuine birth certificate, then why won’t they just submit the stupid thing to Malihi?
Anybody with half a brain has to be asking that question.
On top of that, his attorney is not going to submit documents he knows to be fraudulent. Jablonski is not going to go to prison and get disbarred for Obama. That's the real reason Jablonski is not going to be at the hearing.
