Holder Says Obama’s Recess Appointments Legal

President Obama’s refusal to acknowledge the Senate’s pro forma sessions as an impediment to his authority to make recess appointments was upheld by his Department of Justice last week.

“This country needs to be governed 24/7,” said Attorney General Eric Holder. “Things can’t be brought to a standstill just because the legislature isn’t in session. If the Senate won’t confirm the president’s actions when it is in session he is perfectly within his rights to act when they are out-of-session.”

Holder contended that “the President’s recess appointment authority applies to any and every smidgen of time that the Senate is not doing business—including overnight or even ‘bathroom breaks.’ The fact that previous Presidents may have allowed themselves to be stymied by pro forma ruses has no bearing on the legality of President Obama’s decision to go forward with his right to rule this country.”

Senate Majority Leader Harry Reid (D-Nev) who used pro forma sessions to block some of former President Bush’s nominees concurred with Holder’s assessment. “Just because Bush was cowed by our bluff doesn’t mean President Obama has to,” Reid bragged. “In fact, his governing vigor has set a new standard for all time.”

Holder is a caricature of a lawyer, and Dept. of Justice is a misnomer.

Where are some Congress critters with a little macho? Is it all residing in the female conservative branch?--Never mind. I can answer that question.

So would not thinking like that (we'll call it the "24-7" rule....) also mean that when Obama is on vacation or playing golf, that the congress can pass a bill and sign it into law without waiting for the President's signature?

Question: Does this logic apply to SCOTUS appointments?

And if not and he does it anyway, who will argue and decide the case?

Actually, the Constitution specifies a precise time frame for that. Ten days, if I recall. That having been said, the job of legislating is supposed to be done by legislators. If cabinet officials are going to have any ability to make pronouncements which have force of law, then it is only right and proper that the legislature have the power to block the appointment of anyone whose pronouncements they would not expect to approve. It seems far more reasonable to interpret the Constitution as saying that when the Senate has voiced its disapproval of a President's selections, the position will remain vacant until such time as the President submits someone whom the Senate approves, than to say that a President who is willing to wait until he can declare the Senate out of session should be able to appoint whomever he wants. Given the latter interpretation, what real power would the Senate have? Why would the Constitution bother setting out any rules if not to give the Senate some real power?

When whites did it , it was called racism, but when blacks do it ,it’s called sticking it to”the Man”.

Obama has been getting away with it for 3 years now.

I am surprised this is even a news story.

If Eric Holder did not agree with Bracko Bama, that would be news. Also when did Eric Holder get his seat on the Supreme Court. And why are Republicans on the Congress not up in arms over this. Even Democrats should be up in arms, since when Bracko gets defeated, it leaves a precedent for any Republican President to do the same thing.

I seem to recall a county down in South America who’s President suspended their two term limit and wanted to run again. What happen? The county’s congress went to the judges and got a arrest warrant for their president which fled the county and our State Department backed him instead of their Constitution. Only if we and a Congress as committed to our Constitution as they are to theirs OBama should be impeached.
