Well, seems like Nancy Pelosi and Alice Travis may have a need to worry.
We are a closed party state. PER SD State election law, ALL candidates(Independent) or their parties(DNC & RNC) are required to sign a sworn oath that the candidate for that party is eligible for the office they are office in which they are wish to attain before the SOS places the candidates names on the ballot. In 2008, the SOS bypassed this procedure for the DNC. WHY?
Nope, no language there saying that the candidates nominated are qualified/eligible under the provisions Article II of the Constitution of the United States

Many, many states require the state party to confirm the Constitutional eligibility of their Presidential and Vice Presidential candidates. Hawaii is included in that. But Hawaii also has a provision to allow the National Party to submit the candidates for the ballot AND allow the CEO the discretion to make the final decision on which one to use if needed. It was needed in 2008. The local party, headed by now Lt. Gov. Brian Schatz did not submit the normal candidate declaration. They omitted the constitutional language! The document was legally worthless. So Ms. Pelosi and the DNC had to modify their usual document to include the legally required declaration of constitutional eligibility. That is what got Obama and Biden on the ticket in Hawaii in 2008. The local guys REFUSED to confirm their constitutionally eligibility!

BTW, every state has different laws. Some even knowingly allow ineligible candidates to be on the ballot. Hawaii has one of the more strict laws and does require the statement of constitutional eligibility and Brian Schatz, native Hawaiian, graduate of the same high school as Barak Obama, current Lt. Gov. REFUSED to confirm the eligibility.

I realize this and I am very familiar with what went down. I spoke with the SD SOS office prior to receiving the copy of the DNC certification of nomination. They told me that the rules for the DNC & the RNC are the same as what is required by the Independents who file in our state to be on the ballot. The DNC certification is suppose to have the qualification language in it. That certification was the lone piece of information the SOS used to qualify the candidates as being eligible. A piece of paper that stated NOTHING as to the candidates eligibility. He ran for our lone US House of Rep seat in the primaries and he got creamed. We may not be a big population state, but we still have enough conservatives to keep those who don't do their job off the ticket. Jackley knows we are watching & will be checking for proof of Obama's eligibility in 2012.

Sad to say but I haven’t shot a gun since 1978. Plus the fact that it is dark outside and there are no less than 10 farm cats in the yard at one time, I am nervous even trying to shoot after dark. They only come our after dark to see if tthe catfood has been left out. I was so engrossed in the Judge tonight, I forgot to run out & put it away, so they were right there helping themselves. We live between 2 major creeks, can see the water of both so we have wildlife all the time. I think the woodchucks got the message after hubby nailed a couple and left them out for a while to deter others. Now if we can get a racoon or two to do the same thing.
