I have a question about Arizona gun laws. Where I live, NC, the Sheriff is the one who signs/issues gun permits. Sheriff Clarence Dupnik has been on television slandering everyone and blaming anyone he can. He had previous run-ins with Jared Loughner for making threat. Is this Sheriff the one responsible for issuing Loughner his permit to purchase the firearm used in the assassination attempt and murders?
Aren’t you confusing a CCW, usually issued by the local Sheriff, with the Federal background check to purchase?
You don’t need a permit to buy a firearm in AZ. You can carry open or concealed without a permit. You do need to do the background check when buying handguns from dealers unless you have a ccw permit (which is not needed).
AZ does not require a permit to carry. Background check is standard, and only hits people who have been ruled incompetent by a judge ... which Loughner had not been. Weird people still have the right to bear arms until they can be proven criminal or incompetent in Court.

There are also conflicting reports about the shooters’ drug arrest history. It has been confirmed that he was arrested once and possibly twice. On the first occasion he was allowed to enter a prosecution deferral program whereby if he stayed clean for a year the charges would be dismissed. There are reports he was also allowed to do that a second time as well. This would be a failure at the prosecutors office, of course, but had either case gone to conviction it would have prevented the shooter from passing the background check and buying the gun from a dealer.
NC law requires a permit, purchased from the local Sheriff’s office, to buy a handgun- at which point, they do the background check. Unless you have your CCW, which counts as a permit to buy a handgun.
Yeah, I know. I was thinking about AZ. But, as others have pointed out, that state is light years ahead of the rest.
AZ law forbids gun purchases to those declared "mentally unstable". Dupnick had ample opportunity to do so given Loughner's repeated death threats and psychotic behavior at Pima Community College.
Dupnik once told residents in part of his county to buy guns to protect themselves because he did not believe his department, given its limited resources, could adequately do the job themselves.
We have control of the legislature in NC now. It is time for Constitutional (i.e., Arizona-style) Carry. No permits unless you want to get one so you can be OK to carry in other states.
A sheriff cannot unilaterally rule someone “unstable” and then decide, on his own, to revoke their 2nd Amendment rights. That’s not how due process works ... a sheriff simply does not have that much authority.
Apparently people have the kneejerk reaction of wanting to blame someone other than the trigger-man ... but, not all tragedies are preventable. There’s not always another responsibile party.
In a free society ... a lone nutjob with a vendetta will always be capable of this kind of thin.

I’m inclined to agree, although I enjoyed the CCW class.
