Jack Maskell, an attorney with the Congressional Research Service, prepared this memo in April 2009 in response to members of Congress asking about the eligibility issue.

What he said is practically identical to what Obama’s lawyers put in their case before Judge Carter - right down to the mention that people should take note of the “contemporaneous birth announcement” in The Advertiser. Conflates Fukino’s announcement that they have a birth certificate on record as if it was confirmation that what is posted on Factcheck is what they have on record. Takes what is on the Factcheck COLB as its own authentication - forgetting to mention that he has no idea whether or not what was posted online is genuine, because an online image is not self-authenticating and thus can’t be used for legal proof.

IOW, the legal reasoning is flawed in the whole thing. Basically the whole argument can be summarized as this: It’s up to the states and Obama doesn’t legally have to show a thing. Too bad, so sad. (Followed by all the Obama talking points and disinformation)

I hope you start feeling better. Being sick is no fun. My son was dizzy last night and today; ended up having IV fluids pumped into him because his heart rate was down to 50 and they couldn’t hear a pulse to get a blood pressure reading on him. He’s doing better now. He’s been dehydrated before in spite of eating and drinking normally and I wish we could find out why.

Sorry about your son - is he very thin? Does he eat enough salt?

Wow.

I don’t think I’m getting ready to leave this mortal world but at my age one never knows! A bit better today.

So, this Maskell dude put this jive together in April, no doubt at the behest of 0thugga’s people.

What disgusting nonsense, and the very worst part is that the Rs swallowed it and said nary a word. SICKENING! Every one of them should be asked why they accepted this as truth and were silent as little mice.

Actually, even just reading what this guy wrote about there being nothing federal that requires a candidate to submit a birth certificate - if that candidate wants to be able to receive a federal paycheck they are supposed to submit the same quality of documentation that my son would have to submit if he wants to detassel corn.

So this guy doesn’t even get that part right either.

If I’m remembering correctly the federal office in charge of making that documentation is there basically said they ASSUME that somebody already did that part if he’s held public office before.

I’m thinking about telling the IRS they should ASSUME that I’ve paid my taxes for next year because I’ve paid them every year. Shouldn’t matter whether my income or tax bracket changes. If I was eligible for a particular tax bracket years ago then we’ll just assume I’m eligible for whatever tax bracket I want to be in. This ASSUMING could be really fun. lol

He’s actually overweight and we’ve got a huge history of hypothyroidism in the family. They ran a thyroid test but it’s probably just the standard one that doesn’t measure the free T3. My siblings suffered the symptoms of hypothyroidism for at least 10 years apiece before the lab tests came out saying that their numbers were different than what works for “normal” people. Sort of frustrating because I know that hypothyroidism impacts the whole auto-immune system and I really wonder if that can contribute to the development of diabetes, which is also big in my family.

He’s doing better for now but he’s also very prone to nosebleeds which can also be thyroid-related. My mom had nosebleeds a lot and had really low blood pressure because of the hypothyroidism, so I can’t help but wonder about that connection too.

Is yours a flu bug, or is it something you can treat? I sure hope it gets better fast.

I’m sure this memo was to give all the Congress-critters plausible deniability. Once I realized that Obama’s BC being amended meant that Factcheck had to be a forgery, I contacted my Congress-critters and my governor. Their response was to pass the buck. My governor said he trusted that the people who are supposed to verify eligibility did their jobs. Cough.

And when you look at Judge Lind’s ruling in the Lakin case, that’s basically what she’s saying too - that it would be an embarrassment to Congress if the courts found out that they hadn’t done their jobs. (Even though we already KNOW that the law requiring the VP to ask if there are any objections to the electoral votes was not followed; too “embarrassing” to note the obvious.)

What the heck? How can we have people in critical positions who have no concept of the checks and balances - that the branches of government are separate so that they CAN hold each other accountable on behalf of the people? Why don’t the judges just say that they can’t rule on the Constitutionality of laws because it would be “embarrassing” if it was found out that Congress acted beyond its authority when they made the law?

That is the JOB of the judiciary - to catch when governmental or private entities act beyond the limits of the laws and Constitution. While the government bums are blushing uncomfortably at even entertaining the thought of a politician possibly being less than perfect, the politicians are raping, pillaging and plundering this nation and its future with wanton abandon.

It’s not time for blushing, dang it - any more than it’s time for blushing and stammering in protest when criminals are waltzing into our country intent on beheading, raping, blowing up dams, and shooting people point-blank in order to instill fear/respect so they can do whatever they want. Which of us would stand by and watch our daughter be raped because we were too “embarrassed” to suggest that somebody was acting out of line?

This stuff just really, really bugs me. Where are the good guys?

I know I am preaching to the choir here, but the R's also sat on their hands during the Jan 8, 2009 Joint Session when they had the statutory obligation to ask questions.

One could question whether they took our entire nation out on the thin ice just to gain a perceived future political advantage.

Have a good weekend and Go Tea Party!

“The worst are full of passionate intensity
While the best have lost all conviction.”

WB Yeats, although I may have the lines mangled.

People need courage, conviction, principles. COURAGE! Even if someone has the conviction and the principles, without COURAGE they’re just a pathetic waste of skin and an enabler of evil.

(Sorry to hear about the thyroid etc. I have a crapped out one myself, not fmaily

There is a month and a day left to get anything useful out of the state of Hawai’i regarding Obama’s eligibility. On December 6th, Obama’s closest Hawai’i political friend becomes Governor.

Goodbye Hawai’i Governor Linda Lingle, goodbye Dr. Chiyome Fukino of the Department of Health, goodbye Janice Okubo, Communications Director of the Department of Health, goodbye Dr. Alvin T. Onaka, Registar of Vital Statistics who signed the copies of Obama’s short form COLB, goodbye Hawai’i Attorney General Mark L. Bennett.

Democrat Neil Abercrombie elected Hawaii governor
HONOLULU — Democrat Neil Abercrombie has been elected Hawaii’s next governor.

Abercrombie will be the state’s first Democratic governor in eight years, succeeding GOP Gov. Linda Lingle when he is sworn in on Dec. 6.

Abercrombie, a former 10-term congressman who represented urban Honolulu, defeated Republican James “Duke” Aiona.

Abercrombie’s victory also made former state Democratic Party Chairman Brian Schatz the new lieutenant governor. In Hawaii, candidates for the state’s top two posts run on a ticket.

Aiona had been lieutenant governor.

I think they were afraid of the media.

And unless we expose the media and let them know they can get elected even if the media hates them, we can expect the media to control everything. Which would be a disaster.

I’m hoping that the public waking up to Obama’s thuggery will give talk radio the courage to come out with the story of Soros, Axelrod, and Rahm threatening them and their families if they reported on the eligibility issue.

I hope the CBS folks in Alaska get hammered both by the public and legally because of their scheming to smear Joe Miller.

I hope the public TV station that “forgot” to run Christine O’Donnell’s ads in the 30-minute time-slots she paid for gets taken off the air.

I hope everybody at Factcheck ends up in jail, along with Robert Gibbs and other slimy creatures like Bob Bauer, Nancy Pelosi, and Obama himself.

I want the politicians to admit that they were too wimpy to confront a lying media. I want every last one of them to apologize for the things they said about people like you and me, who only wanted the truth to be known.

I just don’t see Eric Holder putting any energy into locking up Abercrombie or Schatz.

There is some speculation former slaves or free born did not know who their parents were. This is after the ratification. Difficult to prove NBC.

Today we have mostly uneducated voters. They do not know the difference between Republic and an Oligarchy. Jefferson warned of this. They do not care the qualifications of a candidate..all they want to know.. will they get their check.

I read AZ put aside the eligibility legislation only because, at the time, there was so much bad press going on with the immigration law.

But it did seem they would take it up again before the 2012 election.

I think this memo is an excellent find and basis for bringing more light on the fact that there really is NO ONE charged with minding the store when it comes to candidates getting their names on the presidential ballot. That’s incredible!

I think a campaign of infomation, both to the public and to state legislators, that has just a couple of points is necessary and could work. We need to point out that there is a serious lack of formal procedures and process for determining and vouchsafing eligibility.

It doesn’t have to be about any particular candidate; truly, would anyone seriously want to have this controversy occur again in the future? I would hope not.

So all that needs to occur is for at least one state to pass a law setting out procedures for determining eligibility to be on the presidential ballot. And require more than a statement by the candidate or a party hack!

I don’t see anything hard about that, nor does there seem to be any ground upon which to object to such a reasonable and transparent rule, whose only purpose is to vouchsafe the Constitutional requirement that the President be a natural-born citizen.

P.S. I agree completely with your proposal! And, really, who could be against this?

Your no nonsense, warrior attitude is well-documented here on FR and likely elsewhere. A Chair in the state or national hierarchy of the Tea Party should be yours for the asking..
(No, Mr. deZillion, I am not trying to wreck your home life.)

Whatever else the Tea Party stands for – it is willing to stand up for a strong conservative government.

And all the Obot after-Birthers are just drooling hoping that Niel AberCommie will commit fraud to cover for Obama. He probably will do just that.

Marshall wrote in The Neride..in the absence of Congressional enactment, the Courts are bound by the Law of Nations which as we all know is Law of the Land.

1815 is a long time ago..we like to think our politicans are not corrupt.

They are probably the most corrupt in History. We few simple folk on FR have figured it regarding Obama. They must know he is an illegal President.

Are they afraid being labled racist. Is this the knew attack format.

The more information provided on Obama’s status..the racial attacks will begin. They are beginning to do it on FR.

Caracalla killed 20,000 Roman citizens to retain his crown.

One has to wonder what Obama will do once he is cornered.

I’m thinking Iowa could be a good place to have a law requiring documentation to prove Constitutional eligibility to be provided to the Secretary of State before a name can be printed on a primary or general ballot. Since they are the starting point for the primaries and get a lot of attention that way it could prevent problems all the way down the line.

Which state went entirely GOP red in this midterm election? Was it Michigan or Wisconsin? Maybe a state such as that, along with Iowa, would be a good starting point for this eligibility legislation.

Does the Governor-elect need to do anything differently from what Governor Lingle has already done?

“...the president was, in fact, born at Kapi’olani Hospital in Honolulu. And that’s just a fact.”—Governor Linda Lingle (R).
