Colorado "Republican" Sues to Bring Down Taxpayer's Bill or Rights

In my home state of Colorado we have a little thing called the Taxpayer's Bill of Rights, or TABOR. TABOR is a ballot measure that was passed in 1992 by the citizens of Colorado to limit the State from imposing new or higher taxes on Coloradoans without the consent of the citizens via referendum (taxes can escalate based upon population growth and inflation). Herb Fenster, an attorney in Boulder, Colorado, is now suing the citizens of Colorado over TABOR claiming that it violates Article IV, section 4 of the U.S. Constitution which requires the Feds to ensure the States provide their citizens with a republican form of government. He asserts TABOR is a form of pure democracy that prevents the State legislature from performing its most important functions, "tax[ing] and spend[ing]."

No, TABOR was initiated by a majority (2/3s) vote of the Colorado House and Senate BEFORE it went to a vote of the citizens. This, including the vote of the electors, is in full compliance with Article XIX of the Colorado Constitution which addresses constitutional amendments.

Not at all. The socialists have been squirming under TABOR since the day it became law. This is just an old arguement dressed up as a US constitutional, vice Colorado State constitutional, question. As the author said” Put another way: Herb and his ilk don’t like tax caps because it doesn’t let Colorado be completely irresponsible with it citizen’s money”

Colorado Springs follows TABOR and, following the defeat of a tax increase this fall, has had to make some choices. Interestingly, two things seem to be happening. 1. Politicians somehow “find” money and 2. individuals come together to develop private solutions e.g. car pool to Denver instead of riding the taxpayer subsidized, money losing bus (FREX).

It’s a Colorado thing. Range Republicans also do all that they can to prevent drilling for uranium and oil and to prevent owners from using their private properties. It’s the NIMBY/HOA, local big government State.

Yea...well...he lives in Boulder, which for Boulder he probably appears insanely conservative. Recall that Boulder is the city that once (maybe more) proposed taxing people who drove into its city limits.

I’m not trying to defend this guy or his POV but the legislature can’t pass a law giving away authority the U.S. Constitution mandates that it has. Whether this guy has a point or not I don’t know. He lives in Boulder so my gut feeling is “no.” lol

We should just ship Herb Fenster and Boulder to Kalifornia and stop all the malarkey over TABOR. TABOR is here to stay.

Calling Douglas Bruce.

He's on the board of the Center for the American West, which at first blush looks like a bunch of limousine liberal moonbats from boulder.

Cheers!

I think “taxing and spending” are the operative terms. Sounds like the legislature there wants to be free and loose with the people’s money.
