Since it's the States that do it and not the Federal government, no it isn't un-Constitutional. There is no Federal requirement that you purchase car insurance.

States have a long established and well litigated Power to require that certain licenses be obtained and insurance coverages acquired for many reasons.

The Feds, however, have no such Power.

Also, you are only required to buy auto insurance if you actually decide to operate a car. In the case of health insurance, you must buy it if you decide to breathe.

The auto insurance that we must buy is Liability Insurance, to protect the other guy in the event our unintended actions, while operating a motor vehicle, cause damage or injury to another party. If there is a loan on the car, the loaner requires that we have Comprehensive and Collision insurance on the car, to cover their investment. We are NOT required to purchase Medical Payments insurance under an Auto Policy, which reimburses for expenses related to physical injury without regard to liability.

When people, especially liberal politicians, compare the requirement for Health Insurance to Auto Insurance, it’s apples and oranges.

Hope this helps explain the difference.
