Start calling his neighbors instead and find out why they have their panties in a bunch. It might be far more informative to get them to talk, and goad them into a lather to the point they start revealing the truth.
What, specifically, is the wording of the HOA contract in relation to flagpoles? HOA’s are ridiculous, but you don’t have to live in an area with one; you’re free to find a place which doesn’t have one. But if you agree to the HOA covenants when you sign on the line, that’s the deal. It all depends on what the covenants say regarding the flagpole.

It is likely that the community established bylaws and firm rules before he moved in. The board of directors has the legal responsibility to the entire community to require conformity to the rules despite the temptation to give into special examples.
The community is a representative republic, just like the Constitution of this country that this man defended in his war involvement. Now relatives, community members, and the media supports breaking the rules because of a higher morality....respect for an outstanding military record. The argument is that some should be above the law because of their special circumstances, and just think of where that type of thinking will take us.
This is not the spirit or intent of the community to which he belongs. This is the tyranny of the masses, not the rule of law.
His situation can be addressed by an amendment to the bylaws, which can be instituted by the majority of the community acting through the board of directors. Law vs. anarchy??
Good job Silly. I read the Wiki article and some of the news reports. My disgust at the worms that are attacking this hero and our flag is beyond words.
I wonder how his HOA covenants and by-laws read? My guess it is similar to my HOA’s in regards to flag poles. Did he read these and accept them when he bought his home??
We have a process for flag poles and when properly followed it has allowed many homeowners to install flagpoles and fly the flag of their choice.

I guess if the majority of the people in the HOA are for the flag pole, they should show up at the next meeting and ask the board why they are waisting their hard earned money on lawyers for something that doesn’t really matter. Or recall them.

It does not have to be an immediate neighbor. HOAs are rife with self pretentious meddlesome individules. One or two of these types usually make it a point to drive or walk around just looking for violations.
Like them or not, HOAs and their governing documents are there for a reason. If I were living next door to the guy I would probably have the same concerns. Not that I have anything against someone flying an American flag, but because if the HOA doesn't enforce this rule now they may forever preclude themselves from enforcing it when some @sshole wants to fly a Nazi flag on Hitler's birthday, an Islamic flag during Ramadan, etc.
How your neighbors keeps up their property has a bearing on what your property is worth, unfortunately.
This HOA and the flag pole seems completely out of line.
You mentioned paint colors, in a 50’s traditional neighborhood near me, a square 2 story house was built. It looked out of place but new houses are replacing old houses all over. When it was painted it became a real talking point. The folks painted it stop sign yellow, the window and door trim are all different shades of purple and red, as is the brick chimney.
The HOA became unwound but there was nothing in the deed restrictions that mentioned paint color. It still stands there an eye sore, but I guess the owners like it because they haven't changed it.
I was just glad it wasn't next door to me.
